Reiling shall retain the sum of $16,680.00 <br />2. The City shall pay Reiling 43,000 os attomeys fees and costs Incurred <br />herein which amount shall be tendered to Reiling upon receipt of the <br />Grant of Permanent Easement attached hereta as Exhibit A. <br />3. When the Reiling Property is developed, Reiling or their assigns will <br />follow all proc:ec:lures and obtaIn all permits required by the oty's <br />regulations In connection with such development end the City will not <br />oppose the grading or "IIIn9 of the Farmers Pond pursuant tc said Oty <br />permits and regulCltlons. <br />4. The City wI/I not oppose the reQuest of Reiling or their assigns for <br />permits, If needed, from other permitting agencies In connection with <br />such grading or filling of the Fermers Pond. <br />5. The parties shall execute and record the Stlpulation or Dismissal with <br />Prejudice and Without Com attached hereto as Exhibit B. <br />6. The City will reduce the Surface Water Management (SWM) utility fee <br />presently Imposed on the subject property by the area of the <br />easement granted herein. ~nd reimburse Reiling for SWM fees <br />previously paid for the easement area since the date Of orIginal taklng. <br /> <br />2 <br /> <br />e <br /> <br />e <br /> <br />4t <br />
