<br />, <br /> <br />When the Mueller/Rysavys visited with staff, we ruled out a Variance to accommodate the _ <br />Mueller/Rysavys. The one non-resident employee is not a dimension that can be varied. It is a ,., <br />regulation on the permitted use of the site, not a constraint on the development of the site, and <br />therefore cannot be varied. The use of some exceptional permit process was not proposed, as it <br />would not provide a strong foundation for the Mueller/Rysavy's investment or assured use of the <br />office space for their company <br /> <br />. The sole option to accommodate the scale of Mueller/Rysavy's proposed office use of their home <br />is a text amendment allowing more than one non-resident employee nnder special conditions, <br />most probably based on the larger lot size the Mueller/Rysavys could qualify for. <br /> <br />The City struck the balance between accommodation of home offices and preservation of the <br />residential character when it adopted the present ordinance in April, 1993, and limited Home <br />Occupations to one non-resident employee. Prior to the Mueller/Rysavys and the City staff <br />starting the formal and time consuming process ofrevisiting that decision, both the <br />Mueller/Rysavys and the staff ask the Council to provide initial direction on whether that would <br />be a productive process. If the Council remains confident in the balance struck in the April 1993 <br />amendment limiting Home Occupations to a single non-resident employee, the Mueller/Rysavys <br />can chose a design for their home that does not include the 25% office area, and begin their <br />search for office space among the many opportunities offered in the business districts in the City. <br /> <br />e <br /> <br />e <br /> <br />2 <br />
