She noted she wanted to make sure as they move forward they would not lose section 12-30. She added that needed to be validated that with the DNR. e Mr. Steve Nelson, 3475 Siems Court, stated he had previously sent a letter with his issues. He noted the issue was would they have the right to place buoys whether the language was in the ordinance or not. He added it was in the DNR regulations. He stated he would like the Council to consider whether they are complying with state requirements on changing the setbacks. He noted it was confusing for people that they are one of the few lakes, which have a 250-foot setback. He added he would like the Council to consider changing the 250 feet back to 150 feet, which the DNR would allow. He stated that it would be less confusing for those using the lake and would give them a more usable area of the lake. He noted it would also be safer. Mr. Dan Kuechmeister, 3372 Lake Johanna Boulevard, stated he was not sure why anyone would want to change from 250 to 150 when no one was enforcing the 150 feet. Ms. Lisa Abraham, 3511 Siems Court, stated it would be nice ifit was enforceable in the swimming area. She noted her children were almost run over an hour ago 10 feet off her dock. She added she would like not to have to be concerned about her children swimming near their property . As no one else wished to speak, Mayor Probst closed the public hearing at 7:50 p.m. Councilmember Aplikowski stated there were two requests for buoys for the swim areas. She asked how they would be marked other than the City requiring buoys. Ms. Hansen responded the homeowners could buoy their swim areas now. She stated if they had a source or supply for buoys, then the homeowner could mark the area himself or herself. She noted that in some of the lake bays, boats get close. She added marking swimming areas would be of minimal cost to the lake property owner and easily complied with. . Councilmember Aplikowski stated the correspondence from one resident said safety required more policing. She asked if Ramsey County Patrol Officers were out there on the lake. Ms. Hansen responded the Ramsey County Water Patrol does patrol out on the lake. She stated they do an incredible job. She noted they respond promptly after being called. She added there used . to be a citizen patrol. She stated she did not think the response time had ever been longer than 10 minutes on a call. MOTION: Councilmember Aplikowski moved and Councilmember Grant seconded a motion to approve Ordinance 330, an Ordinance relating to Lake Surface Use Regulations, Amending Article 2, Division I, Section 12-16 through 12-19 and Article 2, Division 2, Sections 12-27 and 12-32, and to direct staff to forward the changes to the DNR for their review and approval and to publish it upon acceptance by the DNR. The motion carried unanimously (4-0). e
