. . . r ~ ~~ILLS CITY OF ARDEN HILLS MEMORANDUM DATE: July 26, 2001 TO: Mayor and City Council FROM: Mike Cronin, Interim City Plannerd~1'1G SUBJECT: Case #01-15, Codification City of Arden Hills Flood Plain Ordinance (First Review) Request The City of Arden Hills requests codification of the Flood Plain Ordinance (Exhibit A) into the Zoning Ordinance as a new Section 13 - Flood Plains, and adoption of the present Flood Plain Area Map and the delineated Floodway and Flood Fringe Districts as an overlay to the City's Zoning Map. Back~round The Flood Plain Ordinance, Ordinance #283, was reviewed and adopted in October 1991. During the City's codification process, the decision was made this Ordinance should be incorporated into the Zoning Ordinance. The city is required to adopt and enforce regulations for development within Flood Plain areas, the affected areas in the City are unchanged from those originally mapped by the Federal Emergency Management Agency, and the regulations are enforceable and working well. Therefore, no amendments to the original ordinance are proposed as part of this codification. The mapped flood plain areas are divided into three districts. In the Floodway district, where the prevention of any obstruction to the flow of floodwaters is the objective, no permanent structures are permitted. In the Flood Fringe district, the objective is prevention of damage from flooding and the preservation of flood water storage capacity. Development is generally permitted in the Flood Fringe district if elevated above the predicted flood elevation, or depending on the use, through flood proofing construction techniques. The specific regulations are found at 9.5-29 in the Ordinance. The Ordinance also provides for variances (9.5-43), regulation of non conforming uses (9.5-61) and adoption ofthe Flood Plain Map (9.5-12). 1
