Code - Public Hearinl! .

Chair Baker opened the public hearing at 9:20 p.m.

Staff reviewed their report dated August 28, 2001 and recommended approval for the
reasons contained therein.

Chair Baker asked if Rice Creek Watershed had the opportunity to review this change.
Mr. Cronin replied this was first adopted in 1991 and the only thing that would change
was the numbering system. The request was that if this was approved, they would figure
out exactly where in the Zoning Code this would be codified and they would have this
information for the Council meeting.

Chair Baker closed the public hearing at 9:25 p.m.

Commissioner Sand moved, seconded by Commissioner Erickson, to recommend
approval of Planning Case #01-15, City of Arden Hills, Flood Plain Ordinance, Codify as
part of zoning code, for the following reasons and the following conditions:

1. That prior to final adoption by the City Council the proper location of this
amendment in the Zoning Ordinance is determined by the City Attorney.

The motion carried unanimously (5-0).

.

This Planning Case will be reviewed at the Monday, September 24,2001, regular meeting of the
City Council.

CASE #01-23 - CITY OF ARDEN HILLS - Sil!n Ordinance (First Read)

Staff reviewed their report dated August 28, 200 I and recommended setting this on for a
public hearing on the amendment for the reasons contained therein.

Commissioner Sand asked when the signage process had been started. Mr. Cronin stated
it was started in mid-June and while they realized it was during the summer months that
might have been the reason for the low interest in this issue.

Commissioner Galatowitsch asked where the hardship clause was in this new Ordinance.
Mr. Cronin replied for a sign there was almost never a hardship, it was usually economic.

Commissioner Galatowitsch asked for clarification regarding the wording for the Section
X - Sign Adjustments. Mr. Cronin suggested wording it as Sign Ordinance Adjustments.

Commissioner Sand asked why they did not want to call it a variance. Mr. Cronin replied
they would have to deal with the hardship issue then.

.

Commissioner Sand stated this seemed to be very discretionary. He asked what did
Mounds View use as far as language. Mr. Parrish replied he could not remember what
they called it, but it was a variance issue.
