"!

e

.

.

~
~~HILLS

MEMORANDUM

DATE:

~
April 26, 2002

TO:

Mayor, City Council Members, and City Staff

Joe Lynch, City Administrator {JI/

Non-Agenda for Week Ending 4/26/02

FROM:

SUBJECT:

1. GENERAL ADMINISTRATION

o

Citv Hall
Terry, Dave and I met with PeteT Vesterholt to determine where the architect thinks
Rochon is in accordance with their contract. We all agreed that they are out of
compliance with their contract and we will offer a date of June 1, 2002 for completion
of all items or we will begin hiring contractors to complete the work and utilizing the
remaining portion of their flmds to pay for that work and/or draw on their
performance bond. The terrazzo floor did not turn out well and we are in discussion
with the contractor to determine the best time to have the floor completely removed
and replaced. They are awaTe of the fact that we will not accommodate them during
the work day for replacement of the floor and they will have to complete that either
on a weekend or during the evenings. We have also indicated that if they require
someone to attend to City Hall to let them in and to lock up, they will have to pay for
that persons time.

o Liabilitv Claim
An update on the Hugh Bradley situation. I did receive a report from a professional
engineer that indicates that he does not believe the crack in the Bradley's basement is
due to the water main leak. Mr. Bradley indicated that he would be providing his own
engineer's report and the League of Minnesota Cities Insurance Trust representative
will contact Mr. Bradley indicating that we will await that report and provide him
with ours at the same time to compare. Ifthat happens I will meet with Mr. Bradley
and ask him what it is that he thinks the City did wrong and what he believes we are
responsible for. At this time, I believe that the City is not liab1c for the damage that
occurred to the Bradley's basement foundation wall.

o Rice Creek Watershed District
There is a copy of the letter that we sent to the Rice Creek Watershed District. I will
attempt to contact their new Executive Director and have a meeting with him and
Aaron Parrish to discuss negotiation about the approval of our Stormwater
Management Plan under more favorable tenns.

o

Meetinl! with Government Services Administration and Representative Betty
McCollum
I am working on setting up a meeting potentially for the May 20 W orksession with
GSA and Representative McCollum to discuss how to proceed with TCAAP and
following the GSA excess process.
