Following recording with Ramsey County, the applicant will provide evidence of recording to <br />the City of Arden Hills along with a copy of the registered land survey. <br />5. Payment of the appropriate park dedication fee as determined by an independent appraisal <br />provided by the applicant. <br /> <br />Based on conversations with the applicant and City Engineer, it was determined that it was not <br />imperative that condition #2 be incorporated included as a condition of approval. This is due to the <br />fact that existing utilities are in place to serve the site, so the City has no immediate or anticipated <br />need for the easement Staff would suggest omitting this condition if the project were to be <br />approved. <br /> <br />Additional Issues <br /> <br />As the applicant's statement and the March 21, 2002 memo to the Planning Commission indicates, <br />the applicant is requesting a waiver or reduction of the park dedication fee. With regard to payment <br />of the park dedication fee, Chapter 11, Section 1130.08, 0 of the City Code indicates the following: <br /> <br />"Cash in lieu of dedication. In lieu of the dedication ofland for recreational and conservation purposes, the <br />City. Council may require the developer to pay to the City, as an eqnivalent contribution, an amount in cash <br />equal to the percentage of the land required to be dedicated, multiplied by the fair market value of the property <br />at the time of final approval of the development application. The fair market value of the property shall be <br />detennined by reference to current appraisal data or sales information. When appraisat data is utilized, the <br />developer shall reimburse the City for tbe cost of the appraisal prior to the issuance of any development <br />pennits." <br /> <br />. <br /> <br />Given the number of lots/new housing units to be created, this lot requires the minimum dedication <br />amount of six percent Since the lot will be given to the applicant's daughter, sales information <br />would not be an accurate representation of market value. In this instance, an independent appraisal <br />would be required to determine market value. From staffs perspective, the Council has three <br />general options: <br /> <br />1. Require payment of the code required park dedication fee amount. <br /> <br />For comparative purposes, the most recent park dedication fee paid was $4500 for a <br />16,575 square foot lot Since the newly created lot is over twice the size of this lot at <br />39,256 square feet, it is anticipated that the fee for this property would be higher. <br /> <br />2. Require payment of the code required park dedication fee amount based on a <br />different standard of market value such as the County's assessed market value. <br /> <br />Ramsey County's assessed market vaiue for the land is currently $74,500 for the entire <br />1.6 acres. On a proportional basis, this represents a market value of $41,168 for the <br />newly created lot, which translates into a park dedication fee of $2,470. <br /> <br />3. Provide a waiver of the entire park dedication fee. <br /> <br />. <br /> <br />Ultimately, it is a judgment call on the part of the Council when deciding on which of the above <br />
