ARDEN HILLS CITY COUNCIL Jl,fEETING MINUTES
MAY 28, 2002

6

.

Council Member Larson asked how there was an adverse affect to adjacent
property owners. Mr. Parrish replied there was no adverse affect to the adjacent
property owners.

Mayor Probst asked what the City Code said with respect to flag lots. Mr. Parrish
replied if there was a flag lot, they needed to address an access issue and certain
street frontage issues, but the Code did not specifically prohibit flag lots.

Tom Goserud, 4350 Hamline Avenue, stated they did not have a drainage problem.
He stated he did not understand why this became an issue at the Planning
Commission meeting. He indicated there were a lot of trees, grass, and shrubs
growing along the southern property line and there were no drainage issues. He
stated there would be no trees removed if this were approved. He presented the
background on his property and stated the City had landlocked his property
through various past actions. He indicated this may not be an ideal proposal, but it
was the best that could be done with the property at this time.

Council Member Grant asked if the driveway would be a separate driveway. Mr. .
Goserud stated they would use the same curb cut, but then split off.

Council Member Larson asked if this proposal went forward, was Mr. Goserud
going out of the nursery business. Mr. Goserud stated they would not have the
nursery business on the property if this were approved.

Council Member Larson asked if Mr. Goserud also owned the lot directly to the
south. Mr. Goserud replied he did own it and it was his intent to possibly develop
that at some point in the future. He indicated that piece of property already had its
own curb cut.

Council Member Rem asked if the Planning Commission had the drainage plan at
their meeting. Mr. Parrish replied they did have the plan, but at that time, a field
inspection had not been conducted subsequent to the Planning Commission
meeting. The City Engineer has conducted a field inspection.

Mayor Probst spoke in favor of the Planning Commission's position. He stated
this plan was very similar to the previous plan that had been submitted. He stated
if they approved this, he was concerned that the adjacent site would also have a
similar plan, and he could not support this as it was presented. He expressed

.
