. . . GRANT OF EASEMENT AGREEMENT THIS GRANT OF EASEMENT AGREEMENT, made a,nd entered into this 84- day of August, 2002, by and between John W. Modesette and Elizabeth A. Modesette, husband and wife (hereinafter "Modesettes"), and the City of Arden Hills (hereinafter "the City"). WHEREAS, Modesettes are fee owners of two parcels of real property in the County of Ramsey, State of Minnesota, described as follows: The East 500 feet of that part of Lot 11, except the southerly 8 feet thereof, Rohleder's Home and Garden Acres, Ramsey County, Minnesota, lying easterly of the highway as presently located and established, according to the plat thereof on file and of record in the office of the Rcgister of Deeds in and for Ramsey County, Minnesota. (hcreinafter referred to as Parcel A) That part of Lot 11, except the southerly 8 feet thereof, Rohleder's Home and Garden Acres, Ramsey County, Minnesota, lying easterly of the highway as presently located and established, according to the plat thereof on file and of record in the office of the Register of Deeds in and for Ramsey County, Minnesota, lying west of the east 500 feet thereof. (hereinafter referred to as Parcel B) WHEREAS, the City has granted a minor subdivision for the above two described parcels of property (which had previously been described as one parcel of property) on the condition that the City receive certain drainage and utility easements over the Parcel A and Parcel B. WHEREAS, Modesettes and the City have agreed upon the easements hereinafter described subject to the restrictions on the use thereof. NOW, THEREFORE, for good and valuable consideration to them paid by the City, the receipt and sufficiency of which is hereby acknowledged, Modesettes hereby grant to the City an easement as follows:
