<br />e <br /> <br />. <br /> <br />. <br /> <br />Article IV <br />Space Determination <br /> <br />4.01 <br /> <br />At the culmination of Phase I, the Consultant shall review the documents <br />and present to the parties its determination of the pcrcentage of space <br />attributable to each party's part of the Project. <br /> <br />4.02 <br /> <br />No change orders may bc approved by the County, which affects the <br />City's space without the prior written approval by tl1e City. If any change <br />order increases the total cost ofthe project, the City must first consent, in <br />writing, to such change or it will not be responsible for a pro rata share of <br />the increased cost. <br /> <br />Article V <br />Phase II <br /> <br />5.01 In the event the City elects to participate in Phase II, the City and the County will <br />negotiate a Memorandum of Understanding outlining the costs, rights, and <br />responsibilities of each party in thc ownership and operation ofthe Project. <br /> <br />IN WITNESS WHEREOF, The parties to this agreement have hereunto set their hands on <br />the dates written below: <br /> <br />COUNTY OF RAMSEY <br /> <br />CITY OF ARDEN HILLS <br /> <br />Chairman <br />Ramsey County Board of Commissioners <br /> <br />Mayor <br />City of Arden Hills <br />
