ARDEN HILLS REGULAR CITY COUNCIL MEETING MINUTES
SEPTEMBER 9, 2002

6

.

that offer down. He indicated the next proposal was 2.6 million and Chesapeake
pay '!. of the real estate taxes in 2002. He noted, this again, was approximately
$66.00 per square foot and after touring the building, they had to turn that offer
down also because they did not believe the property was worth that much. He
stated they had told A.T.S. Steel, Inc. that they could not pay the $2.6 million, but
they would not interfere if A.T.S. Steel, Inc. chose to market or lease the property.
He stated he had learned a month ago that A.T.S. Steel, Inc. was marketing the
property for 2.0 million. He stated once they found that out, they had been
attempting to contact A.T.S. Steel, Inc. because this was a range they felt was
more reasonable for this property. He stated they had never refused to meet or talk
with A.T.S. Steel, Inc. or their attorney. He indicated he believed they could still
work something out that would work for both parties. He stated their interest was
to do the best thing for both A.T.S. Steel, Inc. and Chesapeake Properties. He
stated he hoped to have this ready in 12 months, but there was a possibility he
might need to come back to the Council in 12 months and request another
extension. He indicated it took a lot of time to work out this type of a development
with a large company. He indicated an extension of their PUD was separate from .
their negotiations with A.T.S. Steel, Inc.

Council Member Aplikowski indicated she was struggling with the request for the
12-month extension.

Mayor Probst noted it was not the Council's job to negotiate a selling price
between the buyer and seller and it appeared both the buyer and the seller were at
least willing to sit down and negotiate the sale of this property. He indicated it was
in the City's best interest to extend the time and urged the Council to approve this.

Council Member Grant asked if they had the authority to extend this extension
past the 12 months, if necessary. Mr. Filla replied the Council had this authority
and noted this was not a City redevelopment project, and it was not a project the
City had agreed to exercise its powers on and beyond that, the City had the
authority to do what was in the City's best interest.

MOTION: Council Member Grant moved and Council Member Larson seconded
a motion to approve the twelve-month extension of the Chesapeake
Master Plan Planned Unit Development. The motion carried (4-1) .
(Council Member Aplikowski).
