<br />Draft Letter to GSA and Army <br /> <br />Date <br /> <br />Army <br />GSA <br /> <br />RE: Twin Cities Army Ammunition Plant <br /> <br />Dear GSNArmy: <br /> <br />The City of Arden Hills has engaged in discussions with representatives ofthe Department of the <br />Army and the General Services Administration concerning the future of Twin Cities Army <br />Ammunition Plant (TCAAP), an inactive military industrial facility adjacent to the City. It is our <br />understanding that the Army wishes to dispose of the property and that the General Services <br />Administration is the property disposal agent. The City of Arden Hills is interested in obtaining <br />title to TCAAP. Portions of the property are contaminated and the Army will be responsible for <br />the remediation ofthe contamination. <br /> <br />The normal disposal process of contaminated federal property involves the satisfaction ofthe <br />provisions of Title 42, United States Code, section 9620(h)(3), which requires that the United <br />States provide a covenant to the transferee warranting that all action necessary for the protection <br />of human health and the environment has been taken prior to transfer. However, if certain <br />assurances and protections can be provided, as specified in section 9620(h)(3)(C) of the above <br />cited statute, the United States is allowed to defer the warranty and transfer title before <br />remediation is completed. The deferral in this case must be approved by the Govemor of the State <br />of Minnesota. Given the intended development ofTCAAP and the ability to incorporate <br />remediation and site preparation for development into one process, the deferral of the statutory <br />covenant appears to be appropriate. Further, the response action assurances required for deferral <br />have been considered and do not present an impediment to the City's intended plans. <br /> <br />On behalf of the City of Arden Hills, I request that the Army prepare a Finding of Suitability for <br />Early Transfer, prepare and publish a public notice providing for a comment period of not less <br />than 30 days as required by statute and thereafter request a deferral of the statutory covenant from <br />the Governor. We are available to discuss these mallers with you at your convenience.
