Setbacks - Code Requirement Met. <br /> <br />The setback requirement for comer lots in the B-2 district is 50 feet from the property <br />lines which abut a street. The existing building was constructed 39.8 feet from the east <br />property line; the proposed special use would not encroach any further on the east <br />property line. Furthermore, the only alteration to the size of the building would be to <br />extend the drive-through canopy to the north and to create an entrance canopy to the <br />south. <br /> <br /> <br />Front Yard 50' 67' 54' <br />Rear Yard 20' 152' 137' <br />Side Yard Comer 50' 39.8' 39.8' <br />Side Yard Interior 20' 145' 145' <br /> <br />The Zoning Ordinance states in Section IX, I (Nonconforming Uses, Buildings and Lots I <br />Prohibited Activities: Nonconforming Building); "No nonconforming building shall be <br />increased, enlarged or altered in a way that augments its nonconformity." In this <br />situation the only building alterations are the extension of the canopy to the north (front) <br />and creating an entrance canopy to the south (rear). Theses changes are in conformance <br />with code requirements. <br /> <br />. <br /> <br />2. Lot Coverage - Exceeds Code Requirement. <br /> <br />The requirement for the B-2 zoning district is a maximum of 40%. The property would <br />remain at only 5% of the lot covered by principal and accessory buildings. <br /> <br />3. Landscape Lot Area - Exceeds Code Requirement. <br /> <br />The requirement for the B-2 zoning district is a Minimum Landscape Lot Area of 25%. <br />The expansion of the parking area would leave approximately 67% of the lot as landscape <br />area. <br /> <br />4. Traffic Visibility - Exceeds Code Requirement. <br /> <br />The Traffic Visibility requirements in the Arden Hills Zoning Ordinance are: <br /> <br />On a corner lot, nothing shall be placed or allowed to grow in such a manner as <br />to impede vision between a height of a two and one-half (2 !j) and ten (l 0) feet <br />above the center line grades of the intersecting streets within fifteen (15) feet of <br />the intersecting street rights-o.fway.
