<br />Memo to Planning Commission <br />Planning Case #02-29 <br />Page 4 of 5 <br /> <br />receive such service without having to enter the building and usually while remaining in their <br />automobiles. By way of illustration, but without limitation, drive-in businesses include: <br />drive-in banks, drive-in laundry or dry cleaning establishments, but do not include businesses <br />where prepared commodities, such as prepared food, beverages or dairy products are sold. " <br /> <br />. <br /> <br />Additional requirements for drive-in businesses prohibit, "drive-in businesses, fast food <br />restaurants, and automobile service stations from being located on a site located within <br />the one thousand three hundred twenty (1,320) feet of the boundaries of another such <br />establishment." Currently located within the distance of 1,320 feet of the applicant's <br />property are the following drive-in businesses, fast food restaurants and service stations: <br />a Texaco service station (1306 County Road E), McDonald's Restaurant (1313 County <br />Road E), Wells Fargo Bank (1220 County Road E), TCF Bank (1160 County Road E), <br />and Oasis Market I Mobil service station (3673 Lexington Avenue). It is clear that the <br />City has allowed businesses to operate within this distance and the re-use of the <br />applicant's building for a drive-in bank would be consistent with previous decisions. <br /> <br />Drive-in businesses are also required to comply with the following regulation according <br />to Section VI, D, 2, f; "No permanent of temporary signs visible from a public street shall <br />be erected without approval of the council." In accordance with this provision, staff has <br />requested that the applicant provide a signage plan for new signage to be erected and <br />present it to the Planning Commission and City Council. Staff has included submittal of <br />a plan for signage to be erected as a condition of approval. The existing freestanding sign <br />is considered as legally non-conforming, and therefore the sign copy could be changed <br />but the sign could not be expanded without bringing it into code compliance. The <br />existing freestanding sign would therefore not need to be included in the plan of signage <br />to be erected. <br /> <br />. <br /> <br />Deadline for Al!encv Actions <br /> <br />The City of Arden Hills received the completed application for this request on October <br />14, 2002. Pursuant to Minnesota State Statue, thc city must act on this request by <br />December 13,2002 (60 days), unless the City provides the petitioner with written reasons <br />for an additional 60 day review period. The city may with the petitioner's consent extend <br />the review period beyond the 120 days. <br /> <br />Options <br /> <br />I. Recommend approval as submitted. <br />2. Recommend approval with conditions. <br />3. Recommend denial. rfthe City denies the petitioner's request, "... it must <br />state in writing the reasons for the denial at the time that it denies the request". <br />4.
