PARTIES. This Agreement is entered into this 27 ~ day of <br />~~ ' 199~, by and between the Cities of Arden Hills, <br />New Brigh on, North Oaks, Roseville, Shoreview and the Lake Johanna <br />Fire Department, Inc., a Minnesota non-profit corporation <br />(hereinafter "LJFD"). <br /> <br />II. RECITALS. The purpose of this Agreement is to provide for, <br />maintain and equip a Hazardous Materials Response Vehicle <br />(hereinafter "HMRV") which can used to abate and/or contain <br />hazardous material leaks and spills occurring within the Cities of <br />Arden Hills, New Brighton, North Oaks, Roseville and Shoreview; and <br />to further provide a mechanism to insure that the members of the <br />New Brighton Fire Department, the Roseville Fire Department and the <br />LJFD are trained and equipped to operate the HMRV. Each party to <br />this Agreement has concluded that this type of equipment, training <br />and service is more economically feasible if provided by means of <br />a Shared Service Agreement. <br /> <br />At the present time, the LJFD provides fire protection services to <br />the Cities of Arden Hills, North Oaks and Shoreview pursuant to <br />separate agreements with each City which l?-?tablJ.sh LJFe.':.as an <br />independent contractor. Nothing :',h.erE:lir{./ sh 11'1. 1 be" construed as <br />al tering or amendii'Jg'.t ..t,{e independ'ent contractor relationship <br />between the LJFD and the Cities of Arden Hills, North Oaks and <br />Shoreview; nor any manner as creating an agency relationship <br />between such parties. <br /> <br />III. TERMS AND CONDITIONS. In consideration of the mutual <br />undertakings herein expressed, the parties agree as follows: <br /> <br />I. Operations Committee. The Operations Committee shall be <br />comprised of ' the fire chiefs for the New Brighton Fire <br />Department, the Roseville Fire Department and the LJFD or <br />their designees. The Operations Coromi ttee shall be <br />responsible for the following activities: <br /> <br />a. <br /> <br />Management of the HMRV. <br /> <br />b. <br /> <br />Establishment of training standards for personnel <br />which will then be implemented individually by the <br />appropriate officers for the New Brighton Fire <br />Department, the Roseville Fire Department and the <br />LJFD. <br /> <br />1 <br />
