<br />. <br /> <br />. <br /> <br />. <br /> <br />DRAFT <br /> <br />AGREEMENT RELATING TO THE AMENDMENT TO THE RICE CREEK NORTH REGIONAL <br />TRAIL CORRIDOR MASTER PLAN AND FUTURE ROAD AND UTILITY EASEMENTS <br /> <br />1.0 Parties. This Agreement is entered into by and between the City of Arden <br />Hills, a Minnesota statutory city (the "City") and Ramsey County (the <br />"County"). <br /> <br />2.0 Recitals. <br /> <br />A. The Twin City Army Ammunition Plant ("TCAAP Site") is located within <br />the City. <br /> <br />B. It is anticipated that the right to utilize a portion of the TCAAP Site will <br />be conveyed in some manner to the County and that a portion of the <br />TC,4.AP Site will be conveyed to the City, all as illustrated on Exhibit A <br />, <br />attached and entitled "Transfer Area Map". <br /> <br />C. The County will request title to Transfer Areas A and B. The City will <br />request title to Transfer Areas C, D and E. <br /> <br />D. <br /> <br />The County has adopted a Regional Trail Master Plan that includes <br />Transfer Area A, which has been approved by the City and the <br />Metropolitan Council. Transfer Area B is not part of the approved <br />Regional Trail Master Plan. <br /> <br />E. The County is in the process of adopting an amendment to its Regional <br />Trail Master Plan entitled "Proposed Amendment to the Rice Creek North <br />Regional Trail Master Plan" (the "Wildlife Corridor Amendment"), <br />attached as Exhibit B. <br /> <br />F. Transfer Area B is included in the Wildlife Corridor Amendment, which <br />indicates that there would not be public roads or utility lines <br />constructed over or within Transfer Area B. <br /> <br />G. In order to be eligible for certain regional and state funding for park <br />improvement projects to be constructed in Transfer Area B, the Wildlife <br />Corridor Amendment must be approved by the Metropolitan Council; <br />and, in order to comply with Minnesota Statutes, the County's <br />acquisition of an interest in Transfer Area B must be approved by the <br />City. <br /> <br />H. <br /> <br />The City has adopted a Comprehensive Plan which has been approved by <br />the Metropolitan Council. The City's Comprehensive Plan includes all of <br />the Transfer Areas and anticipated: <br />
