<br />DRAFT <br /> <br />1. <br /> <br />That a road would be constructed through Transfer Area B in <br />order to connect Transfer Areas C and E; and <br /> <br />. <br /> <br />2. That a bridge and road would be constructed over Rice Creek in <br />order to allow the connection of Transfer Areas C and D to County <br />Road I. <br /> <br />3.0 Terms and Conditions. NOW, THEREFORE, in reliance upon the representations <br />and in consideration of the mutual undertakings herein expressed, the parties <br />agree: <br /> <br />A. The City approves the Wildlife Corridor Amendment and consents to the <br />County's acquisition of an interest in Transfer Area B, subject to the <br />following conditions: <br /> <br />1. Prior to or concurrent with the County's acquisition of an interest <br />in Transfer Area B: <br /> <br />(a) <br /> <br />The County will provide to the City a road/bridge access <br />and utility easement across Rice Creek near 1-35W (in the <br />approximate location of the existing County Road H bridge) <br />in dimensions that would allow the cOnstruction of a <br />normal city street and would allow the City to link Transfer <br />Areas C and D. The road design, subject to review and <br />approval by the County, shall accommodate unrestricted <br />wildlife movement, drainage functions and human <br />recreational travel under the road. The cost of design and <br />construction and of the road will be borne by the City <br />and/or developer; and <br /> <br />. <br /> <br />(b) The County will join with the City to request that the <br />National Guard provide to the City a road easement from <br />Transfer Area E to County Road I. In the event that the <br />National Guard does not grant a road easement from <br />Transfer Area E to County Road I, the County will permit <br />the City to construct a road through Transfer Area B, <br />generally located on the alignment of the existing <br />north/south road. The road design, subject to review and <br />approval by the County, shall incorporate an elevated <br />section of sufficient height and width to accommodate <br />unrestricted wildlife movement, drainage functions and <br />human recreational travel under the road. The cost of <br />design and construction of the road will be borne by the <br />City and/or developer; and <br /> <br />. <br /> <br />2 <br />
