<br />, <br /> <br /> <br />~- <br />EN HILLS <br /> <br />. <br /> <br />December 18, 2002 <br /> <br />Mr. Glenn Rotondo <br />Deputy Regional Administrator <br />U.S. General Services Administration <br />10 Causeway Street, Suite 925 <br />Boston, MA 02222 <br /> <br />RE: TWin Cities Army Ammunition Plant <br /> <br />Mr. Rotondo, <br /> <br />the City of Arden Hills has engaged in discussions with representatives of the <br />Department of the Army and the General Services Administration concerning the futUre <br />of Twin Cities Army Ammunition Plant (TCAAP), an inactive military industrial facility <br />within the City, It is our understanding that the Army wishes to dispose of the property <br />and that the General Services Administration is the property disposal agent. The City of <br />Arden Hills is interested in obtaining title to portions of TCAAP. More specifically, the <br />City would like to pursue title to the areas C. D, and E generally outlined on the attached <br />map. It is anticipated that Ramsey County would pursue areas A and B for parks and <br />open space. Portions of the property are contaminated and the Army will be responsible <br />for the remediation of the contamination. <br /> <br />. <br /> <br />The nonnal disposal process of contaminated federal property involves the satisfaction of <br />the provisions of Title 42, United States Code, section 9620(h)(3), which requires that the <br />United States provide a covenant to the transferee warranting that all action necessary for <br />the protection of human health and the environment has been taken prior to transfer. <br />However, if certain assurances and protections can be provided, as specified in section <br />9620(h)(3)(C) of the above cited statute, the United States is allowed to defer the <br />warranty and transfer title before remediation is completed. The deferral in this case <br />must be approved by the Governor of the State of Minnesota. Given the intended <br />development of TCAAP and the ability to incorporate remediation and site preparation <br />for development into one process, the deferral of the statutory covenant appears to be <br />appropriate. Further, the response action assurances required for deferral have been <br />considered and do not present an impediment to the City's intended plans. <br /> <br />On behalf of the City of Arden Hills, the City requests that the Army and the General . <br />Services Administration begin negotiations to develop an arrangement for the early <br />transfer of the property and for an environmental cooperative services agreement <br /> <br />City of Arden Hills . 1245 West Highway 96 .
