<br />ARTICLE XVI PROBATIONARY PERIODS. <br /> <br />16.1 All newly hired or rehired employees will serve a minimum of si~ <br />(6) month's probationary period. <br /> <br />16.2 All employees wi1l serve the probationary period in any job class- <br />ification for which has not served one previously. <br /> <br />16.3 At any time during the probationary period, the probationary employee <br />may be discharged at the sole discretion of the Employer. <br /> <br />16.4 At any time during the probationary period, a promoted or reassigned <br />employee may be demoted or reassigned to the employee's previous <br />position at the sole discretion of the Employer. <br /> <br />16;5 At least three (3) weeks prior to the completion of the probationary <br />period, the Clerk Administrator shall r.eview the performance of the <br />probationary employee and notify the Council of his recommendations. <br />The matter shall be placed on the Council agenda for the next regular <br />meeting, at which time the Council shall consider the recommendation <br />and make a determination as to whether the employee shall be continued <br />as a regular employee, or whether he shall be terminated at the end <br />of the probationary period. If he is not to be continue beyond <br />the end of the probationary period, the employee shall be so notified <br />before the end of such period. <br /> <br />ARTICLE XVII SAFETY. <br /> <br />The Employer and the Union agree to jointly promote safe and healthful <br />working conditions, to cooperate in safety matters and to encourage employees <br />to work in a safe manner. <br /> <br />ARTICLE XVIII JOB POSTING <br /> <br />18.1 The Employer and the Union agree that permanent job vacancies within <br />the designated bargaining unit shall be filled based on the concept <br />of promotion from within provided that applicants: <br /> <br />18.11 have the necessary qualifications to" meet the standards of <br />the.job vacancy; and <br /> <br />18.12 have the ability to perform the duties and responsibilities <br />of the job vacancy. <br /> <br />18.2 Employees filling a higher job class based on the provisions of this <br />Article shall be subject to the conditions of ARTICLE XVI (PROBATION- <br />ARY PERIODS). <br /> <br />18.3 The Employer has the right of final decision in the selection of <br />employees to fill posted jobs based on qualifications, abilities <br />and experience. <br /> <br />18.4 Job vacancies within the designated bargaining unit will be posted <br />for five (5) working days so that members of the bargaining unit <br />can be considered for such vacancies. <br /> <br />ARTICLE XIX WAGES AND FRINGE BENEFITS. <br /> <br />19.1 BASE PAY RATE - NEW EMPLOYEES <br />After the effective date of this Agreement (i.e., January 1, 1985), <br />a new employee shall be paid such base rate during his probation <br />period as the Employer's Council in its sole discretion determines <br />to pay him, provided that it is at least seventy percent (70%) of <br />the regular employee's base pay rate. If the Council decides, at <br />the end of his probationary period, to continue him as a regular <br />employee, his base pay rate shall be increased, for a period of six <br />(6) months after his probationary status has been removed, to such <br />rate as the Council in its sole discretion determines to pay him, <br />provided that it is at least eighty percent (80%) of the regular <br />employee's base pay rate, and it shall be increased again by the <br />Council to such rate as the Council determines in the exercise of <br />its sole discretion, provided that it is at least ninety percent <br />(90%) of the regular employee's base pay rate, for a period of one <br />(1) year beginning with the commencement of his second year of <br /> <br />-6- <br /> <br />, , <br /> <br />. <br /> <br />I <br />
