<br />zoning ordinance, the zoning ordinance will be brought into conformance with the plan by the <br />local government in conjunction with its review and update of its comprehensive plan required <br />by December 31, 1998. " <br /> <br />. <br /> <br />Subsequent to the City Council approval of the Comprehensive Plan on November 8, 1998, the <br />Zoning Ordinance was amendcd to create thc Neighborhood Business District by Ordinance 315 <br />(adopted on September 27, 1999). It appears that most of the areas designated in the <br />Comprehensive Plan as Neighborhood Business were re-zoned to coordinate with the <br />Comprehensive Plan designation. Thc area presently being discussed appears to have been <br />overlooked as part of that effort. <br /> <br />Staff Comment <br /> <br />There have been several inquiries from developers interested in constructing either residential <br />homes or neighborhood business buildings in this area. It is staff's beliefthat were a moratorium <br />not enacted, that the described property could be developed in a manner inconsistent with the <br />Comprehensive Plan before the City had a chance to review and amend either the Zoning Map or <br />the Future Land Use Map (Comprchensivc Plan Map). A moratorium would provide the <br />necessary time for the Future Land Use Map and Zoning Map to be reexamined by the Planning <br />Commission and Council, and the necessary changcs made to insure that development would be <br />consistent with the Comprehensive Plan. <br /> <br />One of the dangers of not taking any action to amend either the Zoning Map or the Future Land . <br />Use Map is that thc conflicting map designations could permit developmcnt which does not <br />conform to the City's Comprehensive Plan and could have undesirable results. Hypothetically, a <br />single-family residence could be located in an area currently zoned as R-2 (Single and Two <br />Family Residential) but designated on the Future Land Use Map as Neighborhood Business All <br />that would currently be required is a building permit from the City Building Official. <br />Subscquently, a developer could submit an application for rezoning of a neighboring property <br />from Single and Two Family Residential to Ncighborhood Business (based on the fact that thc <br />re-zoning would be consistent with the City's Comprehensive Plan the City would have very <br />limited grounds for denying such a rezoning request). The neighboring properties could be re- <br />zoned and developed in such a fashion and the rcsult would be that the landowner who <br />constructed the single-family residence could then be the only rcsidential usc (or residentially <br />zoncd parcel) in between two arcas of Neighborhood Business. <br /> <br />Nei2hborhood Notice and Impact <br /> <br />All affected property owners were sent a detailed letter with attachments stating that the Council <br />would be reviewing this item at the February 10th Council mceting. The Council, Planning <br />Commission and certain staffwere sent copies of this lctter bye-mail. <br /> <br />Efforts have been made to mitigate the impact of the moratorium on the affected property owners <br />by allowing the east 300 feet of properties (where possible) to be excluded from the moratorium. <br /> <br />PC #03-03 - Councit Memo 021003 - Page 2 of4 <br /> <br />. <br />
