<br />WHEREAS, the Minnesota Department of Transportation has determined the storm sewer is <br />eligible for County State Aid Highway funds. . <br /> <br />NOW, THEREFORE, IT IS HEREBY MUTUALLY AGREED AS FOLLOWS: <br /> <br />I. The County shall prepare the necessary plans, specifications and proposals. Cost ofproject revisions <br />after completion of plans and specifications will be paid for by the party requesting the revisions or <br />as defined by supplemental agreement. Revisions must be consistent with State Aid requirements <br />and are subject to County approval. <br /> <br />2. The County shall take bids and award a contract for construction of the subject project. <br /> <br />3. The County shall administer the acquisition of all rights of way and easements required for the <br />construction of the project in accordance with State Aid requirements and all applicable Federal and <br />State Statutes. The County shall provide all compensation to property owners for acquired rights of <br />way and easements. In the event the City requests work not included within the original plans, the <br />City will be responsible for costs for any additional rights of way required. <br /> <br />4. All acquired road rights of way and temporary easements will be in the name of the County, and <br />parking and other regulations will be controlled by the County. Any right of way acquisition which <br />cannot be negotiated, will be acquired through eminent domain proceedings by the County, or <br />eliminated through design revisions, as determined most appropriate by the County. <br /> <br />5. The County and City shall participate in the costs of construction in accordance with the Estimated <br />Cost Participation Summary, attached as Exhibit A and incorporated herein, except as modified <br />below. <br /> <br />. <br /> <br />6. The County and City shall participate in the costs of storm sewer construction to the extent identified <br />by the MnlDOT Hydraulics Engineer's Memorandum on storm sewer cost participation percentages. <br /> <br />7. Upon completion of the project the County shall own and maintain all storm sewer catch basins, <br />leads and outfalls which are located within County road rights of way and directly serve the paved <br />portion of Highway 96 or intersecting County roadways. The main trunk storm sewer in the portion <br />of Highway 96 within the City shall be owned and maintained by the City. It is acknowledged that <br />the County and City of Arden Hills support the construction of stormwater treatment facilities for the <br />purpose of treating drainage from within the project area It is acknowledged that stormwater ponds <br />serve a watershed function. Maintenance and operations costs associated with both pond features <br />constructed with the project will be shared by Ramsey County and the City of Arden Hills. <br />Maintenance shares shall be commensurate with each agency's respective contributing watershed <br />areas, weighted to reflect an appropriate runoff coeficient for the type of development and/or land <br />use present. Participation shares include costs incurred by either party in the performance of <br />operations and maintenance activities. For the pond on the northwest comer of Ham line and <br />Highway 96, it is agreed the percentage split of 90% County and 10% City shall be the basis for <br />sharing cost. For the pond on the southeast comer of US Highway 10 and Highway 96, it is agreed <br />the percentage split of 80% County and 20% City shall be the basis for sharing cost. Either party . <br />may perform work or hire work to be done, subject to notification to and concurrence from the other <br />party. <br /> <br />PW2003-04-2 <br />
