A total of <br />22 written appeals were received by City staff from the affected residents ofthe project. Staff has <br />reviewed each appeal and prepared a written response letter to each individual explaining the <br />assessment calculation and notifying them of the current staff recommendation (adjustment or no <br />change) regarding their assessment. Of the 22 appeals received, staff is recommending that <br />adjustments be made to 5 assessments based upon lot geometry etc. In most cases where staff <br />recommends adjustments, multiple scenarios apply to the property (ie shallow lot and odd shaped <br />lot) and we have chosen the least costly calculation for the resident(the initial role used a more costly <br />calculation). We have prepared a revised assessment role for the entire project with the 22 properties <br />with pending appeals highlighted. The proposed adjustments (if any) and staff comments for each <br />appeal are included along the right side ofthe assessment role. Copies ofthe letters sent to residents <br />also are attached for Council information. <br /> <br />Many of the appeals were based upon comer lots which were assessed for projects occurring more <br />than 5 years ago. The staff recommendation to maintain the proposed assessments is based upon the <br />current assessment policy. There have been discussions over the past several years regarding the <br />elimination of the 5 year window and Council may decide to rule in favor of these residents based <br />upon those discussions. Regarding the comer lots, staff recommends that the assessments either be <br />levied as proposed or eliminated completely for those residents. <br /> <br />The residents were all informed that they could make their case at the April 14,2003 Council <br />Meeting if they still had an objection to the assessment. <br /> <br />PROJECTS\ARDENIIIL\37951\GENERAL\Documents\Agenda Memo 4-14-03 Item 5Adoc <br />
