He stated there were other matters to be addressed <br />such as whether or not the AUAR came in on a satisfactory basis as well as a number of <br />things regarding the AUAR that would need to be addressed. He stated he was <br />comfortable with the PUD provided there was a Development Agreement presented <br />sometime in the near future and prior to the Council meeting at the end of the month. He <br />stated his greater concern was where they were heading with the preliminary plat. He <br />stated the preliminary plat did not look anything like the Master Plan. He stated the <br />preliminary plat was subject to reconstruction of Cummings Park Drive and installation <br />of traffic lights. lIe ll-sked if Femwood Aven\le was proposed to be vacated with this <br />preliminary plat. He stated his real concern was where were they going with the <br />preliminary plat. <br /> <br />Mr. Reimer replied the traffic light would be installed at Cummings Drive in 2003. <br /> <br />Mr. Franke asked aQout Lexington Avenue. Mr. Brasch replied they ha,d no control over <br />Lexington Avenue. <br /> <br />. <br /> <br />Mr. Parrish replied the City CO\lllcil would approve th.e Development Agreement, the <br />final AUAR, and Final Plat. He stated the Commission would not consider these. He <br />stated the City would have a forrqal process to vacate the easement on Femwood Avenue <br />and there were various State laws that governed this. He stated the planning Commission <br />would need to mlJ.ke a deterrqination with the ea.sement that it was consistent with the <br />City's Comprehensive Plan. With respect to the IleveloPment AgreemeQt, the City <br />Council ultimll-tely needed to approve thll-t. In this ipstll-nce, thegelleral practice hil-d been <br />that they do not dOIlevelopment Agreements on the front elld. He stated the public could <br />see the Development Agreernellt prior to it being approved by Council if they wapted. <br /> <br />Mr. Franke stated the City should not vacate Fernwood Avenue or approve the plat until <br />Guidant knew Where. t.hey were going. He stated the process Was backward here. He <br />indicated all of the iss.ues needed to be addressed before the plat was approved or <br />Fernwood Avellue was vacated. He noted th.e environmental study needed to be <br />completed. He stated he liked the PUD, b\lt the process was fractured and they needed to <br />spend more time fOclJsing on the details. <br /> <br />Sharon Klumpp, 1278 Wyncrest Lme, stated the neighborhood committee understood a <br />lot of the details regarding traffic. She asked if they went forward with approvll-ls that <br />were contingent l!pOll the .Council's approval of the Development Agreement, etc. Sh.e <br />stated she wolJld feel better if this was approved contillgent upon approval of the <br />Development Agreement and the AUAR. Mr. Parrish replied it had been the practice of <br />the City that conditions were l!sually added. In terms of the Development Agreement, <br />that was stmdard practice and ifthe application was approved, it was something that was <br />approved by the City Council. He observed that one of the main issues of concern was <br />the proposed phasing plan. Mr. Parrish stated that the phasing plan would be incll!ded as <br />a condition of the PUD, the Development Agreement, md the AUAR mitigatioll p)ap. <br /> <br />. <br /> <br />Russ Bertsch, 4419 Amble Circle, stated he was concerned about the traffic coming up on <br />Lexington. He $tated he lived in the Karth Lake subdivision and everyone wa$ talking <br />about what was going on in the west md north side, but not on the east. He stated his <br />location off of Karth Lakc was locked in. He noted they only had two ol\t1ets onto <br />Lexington AvenlJe md traffic there was difficult at this time and it appeared to him that <br />
