<br />2 <br /> <br />"an amount not to exceed $4,650," at the April 14 hearing, City staff withdrew its e <br />recommendation and requested that the Council proceed with easement negotiations with <br />the Association on a "no-cost" basis. <br /> <br />The City is requesting that the Association "give" the City a temporary easement across <br />all of its property during the duration of the construction project and "give" a permanent <br />easement for 5500 square feet of property for drainage, utility and pond easements. <br /> <br />The City's request for "no-cost" easements appears inconsistent with the City's interest in <br />water quality improvements; the City's previous purchase of a water main easement from <br />the Association; and community practice. <br /> <br />In the City Engineer's March 24, 2003 e-mail to the Task Force he stated "the value [for <br />the City's requested easements] is more like $1 to $2 per square foot." Ramsey County <br />anticipates paying North Heights approximately $1.69 per square foot for a requested <br />drainage easement. <br /> <br />The City Managers and City Engineers for Moundsview, New Brighten, Roseville, and <br />Shoreview advised the Task Foree that they expect to and do pay for private property <br />easements for projects that benefit their municipalities. In some circumstances, some of <br />the municipalities retain the services of private appraisal firms to determine the market <br />value of the affected land at a cost of $2500-$3000 per project. Typically, the market <br />value is estimated to be $2-$5 per square foot, $5 being for commercial property, The <br />municipalities' payment to the private property owners for the requested easements are <br />typically 50% of the market value; approximately $1-$2.50 per square foot - consistent <br />with the figure provided by the City Engineer. <br /> <br />e <br /> <br />The Task Force remains willing to assist and cooperate with the City in its water quality <br />goals. However, the Task Force is unwilling to agree to terms that would be detrimental <br />to the Association or to its members. The Association Task Force would be derelict in its <br />fiduciary responsibilities to the Association and its members to recommend a "no-cost" <br />casement. Therefore, the Association Task Force is unable to take the City's request for <br />the proposed water quality work to its members until the issue of compensation for the <br />easements is reconsidered by the City and the Council and resolved between the City and <br />the Association Task Force, <br /> <br />To continue to assist the City with its water quality improvement goals, the Association <br />Task Force is willing to propose to the Association members that they accept $0.75 per <br />square foot for the City's requested permanent easements, The Association Task Force is <br />also willing to recommend a "no-cost" temporary easement across its entire property for <br />the City's requested work, contingent upon the execution of an Agreement of <br />Understanding between the City and the Association for the proposed work. <br /> <br />The Association Task Force requests that the matter of compensation for easements to the <br />Association be added to the Council's meeting agenda at the earliest opportunity, A <br />preferably the first Council meeting of May, 2003. ,. <br />
