In order to accomplish its <br />water quality goals, the City proposed extensive work upon the private property owned <br />by the members ofthe Association in the Ingerson Road neighborhood. The proposed <br />water quality project includes the construction of a weir, a French drain, swale and other <br />work to create a holding pond, The City further requested from the Association both <br />temporary and permanent easements across the Association's property, <br /> <br />In a spirit of cooperation and upon the request ofthe Council, the Association formed a <br />Task Force to work with City representatives to design and develop a water quality <br />project so that it met the needs of the City and would he acceptable to the Association. <br />The Task Force and City representatives are close to an agreement on the proposed <br />project scope and design which will meet the water quality goals ofthe City and that the <br />Task Force can present and recommend to the Association members for their vote. <br /> <br />Throughout the Association's discussions with City staff, the Association has adhered to <br />the explicit and adamant instructions of the Council and City staff that the request for an <br />easement across the Association's property should not, and must not, be equated to any <br />assessment the City proposed against the Association's property for any road <br />improvements to Ingerson Court, <br /> <br />Immediately upon the close of the April 14, 2003 assessment hearing, City staff <br />requested the Council pass a resolution allowing the City staffto negotiate the necessary <br />easements across the Association's property. Although City staffrecommended to <br />Council in their February 20, 2003 memorandum that City staff be allowed to negotiate <br />
