.

.

.

Exhibit A

disturbed areas would be seeded or sodded as necessary. All existing bridges on
Association Property will be preserved. If either bridge is damaged during construction,
the City, at its own expense, will repair it and return it to its original condition if not
better.

General: Neither of the permanent maintenance easements allows the City to construct
improvements unrelated to utility or drainage purposes such as trails, roads, etc. If the City
disturbs the surface as a part of maintenance activities, at the City's expense, it will restore the
surface and surrounding area to its original condition - i.e. sod, seed, plants etc. The City will
prepare detailed easement documents including legal descriptions and terms of the easements at
no cost to the Association. Assuming the Association approves this proposed work, in order to
expedite the project, for initial construction purposes only, the City would like to obtain a
temporary construction easement over the entire Association parcel as soon as possible with the
expectation of permanent drainage and utility easements to be drafted and approved at a later
date. It is common (and desired in this case) for permanent easements to be finalized after the
construction therefor allowing the City to survey the actual location ofthe improvements to
insure the easement limits are adequate. However, the final exact footage of the easement will
not exceed the maximum 300 square feet for the Utility Easement and/or the 5200 square feet for
the Drainage Easement.

Dated: May 23, 2003

3
