<br />. <br /> <br />Exhibit A <br /> <br />the project is ready for sodding etc. We generally do not have difficulty asking Contractors to <br />provide access during the projects. Generally the site will be accessible during a large percentage <br />of the project and only during excavation and seeding/sodding/landscaping will the association <br />be asked to avoid the area. It should be noted though that the site may have dirt over much of its <br />area between the grading period and the restoration period and may not be desirable to <br />congregate on. We intend to keep the two bridges open at all times. <br /> <br />Easements <br />The City would like to obtain two easements from the Association for this work as described <br />below: <br /> <br />Utility Easement: This easement would cover the proposed French drain north ofthe existing <br />watennain easement. A total of no more than 300 square feet are proposed for this easement. <br />The easement terms will allow the City only access to inspect/fix/maintainlclean the French <br />drain as necessary to insure it is functioning as proposed. The easement will not allow the public <br />at large access to the site. <br /> <br />Drainage Easement: This easement would cover the basin area from the boulder weir to the . <br />City's property line and would consist of a maximum of 5200 square feet. The easement terms <br />would allow the City only access to inspect/fix/maintainlclean the basin and boulder weir as <br />necessary to insure that they are functioning as intended. The easement will not allow the public <br />at large access to the basin. It is anticipated that City maintenance staff will periodically inspect <br />the weir and outlet pipes in the basin (1-2 times per year) and remove silt deposits from the basin <br />as they accumulate. The silt will be removed from a truck parked on Ingerson Road or <br />Fernwood Court and an extended "vacuum" hose. A long arm type of backhoe is also commonly <br />used for silt removal. <br /> <br />Temporary Construction Easements: <br />. Assuming the Association approves this proposed work, in order to expedite the project, <br />for initial construction purposes only, the City would like to obtain a temporary <br />construction easement over the entire Association parcel as soon as possible (with the <br />expectation of permanent drainage and utility easements to be drafted and approved at a <br />later date). The maximum duration of this temporary easement would extend from June <br />20, 2003 to October 31, 2003 <br />. On a one time basis, near the close of this Fernwood Channel construction project, the <br />City desires to remove approximately 1-2 feet of silt and construction debris from the <br />existing channel between Lake Josephine and the new basin if the Association grants <br />approval. The City would not expand the Fernwood Channel during this process and <br />could even narrow it in places as desired by the Association. Edges would be rounded <br />and biodegradable turf blankets would be installed to stabilize the slopes. Other . <br /> <br />2 <br />
