The Firm has represented waste .
generators at scores of Superfund sites across the country.

The Firm's clients have been among the government's primary targets at many of these
Superfund sites. Firm lawyers, therefore, have played leading roles in defending Superfund cases,
negotiating resolutions, developing unique and creative settlement alternatives, and pursuing third
parties and insurance carriers to help pay the cleanup costs. Two of the many well-known cases in
which the Firm has played leading roles are United States v. Conservation Chemical Co. and United
States v. Hardage. In each, Firm lawyers served among a select group oflead counsel. In Hardage,
one Firm lawyer served as chairman of the Case Management Committee, which successfully directed
the defense of the lawsuit on behalf of 25 defendants and more than 100 members of a generator
defense group. A second Firm lawyer led the generators' defense of the government's multi-million
dollar cost recovery claim.

At several sites Firm members have chaired or taken leading roles in multiparty steering
committees that direct response activities. At many, the Firm has been retained as common counsel
for the groups undertaking response activities. At other sites, the Firm has represented clients who
were not major parties and has sought de minimis settlements on their behalf

In addition to Superfund actions, the Firm has represented numerous clients before various
state regulatory agencies in administrative actions requiring cleanup of hazardous wastes under state

.

2

WA 506775.1
