<br />. <br /> <br />. <br /> <br />. <br /> <br />Exhibit 4: Declaration of Covenants, Restrictions, and Conditions <br /> <br />DRAFT <br /> <br />COMMON INTEREST COMMUNITY NO. <br />PLANNED COMMUNITY <br />RAMSEY COUNTY PUBLIC WORKS FACILITY CONDOMINIUM <br />DECLARATION <br /> <br />THIS DECLARATION is made as of this day of ,20 <br />, by Ramsey County Public Works Facility Condominium Association, a Minnesota non- <br />profit corporation (herein called "Declarant"), pursuant to the provisions of the <br />Minnesota Common Interest Ownership Act, Minnesota Statutes Sections 5158.1-101 <br />through 515B.4-118 (the "Act"), as amended. <br /> <br />RECITALS <br /> <br />WHEREAS, Declarant is the owner of the following described real estate located <br />in Ramsey County, Minnesota, together with any easements thereto, all of which real <br />estate is referred to herein as the "Property;" <br /> <br />See Exhibit "A" Attached <br /> <br />WHEREAS, Declarant intends to develop the Property as a public works garage <br />and government office facility, organized as a condominium under the Act. <br /> <br />NOW, THEREFORE, Declarant declares that the Property is and shall be <br />divided, held, transferred, conveyed, sold, leased, occupied and developed subject to <br />the Act and to the covenants, conditions, restrictions, easements, charges and liens set <br />forth in this Declaration, which shall run with the Property and be binding upon all <br />parties having any right, title or interest in the Property, their heirs, successors and <br />assigns, and which shall inure to the benefit of each Unit Owner, and the heirs, <br />successors and assigns of each Unit Owner. <br />
