<br />therefore not subject to any ordinance of the type authorized or permitted by said <br />statute. <br /> <br />. <br /> <br />3.00 CIC PLAT <br /> <br />3.01 The plat of Common Interest Community No. ,Ramsey <br />County Public Works Facility Condominium, attached to and made a part of this <br />Declaration and any supplement thereto, is the CIC Plat (sometimes referred to herein <br />as the "Plat" or "CIC Plat"). <br /> <br />4.00 OWNERS ASSOCIATION <br /> <br />4.01 Non-profit Corooration. Ramsey County Public Works Facility <br />Condominium has been incorporated as a Minnesota non-profit corporation under <br />Minnesota Statutes Chapter 317A to act as the association of Unit Owners required by <br />Section 515B.3-101 of the Act. <br /> <br />4.02 Services. The Association may obtain and pay for the services of any <br />persons or entities to manage its affairs, or any part thereof, to the extent it deems <br />advisable, as well as such other personnel as the Association shall determine to be <br />necessary or desirable for the proper operation of the Property, whether such personnel <br />are furnished or employed directly by the Association or by any person or entity with <br />whom or which it contracts. The Association may obtain and pay for legal and . <br />accounting services necessary or desirable in connection with the operation of the <br />Property or the enforcement of the Governing Documents. The Association may <br />arrange with others to furnish trash collection and other common services to each Unit. <br /> <br />If entered into prior to expiration of the period of Declarant Control pursuant to <br />Section 5158.3-103 ofthe Act, (i) any management contract, employment contract or <br />lease of recreational facilities, units, garages or other parking facilities, (ii) any contract, <br />lease or license binding the association to which a Declarant or an affiliate of a <br />Declarant is a party, or (iii) any contract, lease or license binding the Association or any <br />Unit Owner other than the Declarant or an affiliate of the Declarant which is not bona <br />fide or which was unconscionable to the Unit Owners at the time entered into under the <br />circumstances then prevailing, may be terminated without penalty by the Association at <br />any time after the expiration of the Declarant Control upon not less than ninety (90) <br />days notice to the other party. <br /> <br />4.03 Personal Property for Common Use. The Association may acquire and <br />hold for the use and benefit of all of the Owners tangible and intangible personal <br />property and may dispose of the same by sale or otherwise. Such beneficial interest <br />shall not be transferable except with the transfer of title to a Unit, provided that an <br />Owner may delegate his or her right of enjoyment of such personal property tenants of <br />his or her Unit. A transfer of title to a Unit shall transfer to the transferee Ownership of <br />the transferor's beneficial interest in such property in accordance with the purpose for . <br />which it is intended, without hindering or encroaching upon the lawful rights of other <br /> <br />4 <br />
