The easements set forth <br />in this Section shall supplement and not limit any easements described elsewhere in <br />this Declaration or recorded, and shall include reasonable access to the easement <br />areas through the Units and the Common Elements for purposes of maintenance, <br />repair, replacement and reconstruction. <br /> <br />11.12 Use and Eniovment Easements. Each Unit shall be the beneficiary of <br />permanent non-exclusive appurtenant easements on and across the Common Elements <br />for the use and enjoyment of the Common Elements, and for use and enjoyment of any <br />Limited Common Elements allocated to the Unit, subject to any restrictions authorized <br />by the Declaration and consistent with the Association's rights therein. <br /> <br />11.13 Access and Parkina Easements. Each Unit shall be the beneficiary of <br />appurtenant easements on or across the Common Elements for access to a public <br />street or highway and for parking in areas located and constructed by the Declarant or <br />as shown on the Plat, subject to any restrictions set forth in this Declaration. <br /> <br />12.00 ALLOCATION OF MAINTENANCE RESPONSIBILITY <br /> <br />12.01 The Exteriors. In order to preserve the uniform and high standard of <br />appearance of the Property, the Association shall be responsible for the maintenance <br />and repair of the Common Elements including, but not limited to, the exterior of all Units, <br />which responsibility shall include, but not be limited to, the following: the maintenance <br />and repair of exterior surfaces of all buildings on the Property, including, without <br />limitation, the painting of same as often as necessary, the replacement of trim and <br />caulking, and the maintenance and repair of roofs, gutters, downspouts and overhangs. <br />All maintenance and repair of the individual Units shall be the sole obligation and <br />expense of the individual Owner, except to the extent the exterior maintenance and <br />repair is provided by the Association by this Section. In the event that the need for <br />maintenance or repair is caused through the willful or negligent act or omission of an <br />Owner, the Owner's, guests, tenants or invitees, the cost of such maintenance or repair <br />shall be added to and become a part of the assessment to which such Unit is subject. <br /> <br />12.02 Lawn and Plantina Maintenance. The Association shall mow, trim, water, <br />rake and otherwise maintain, all to the extent the Board deems necessary or desirable, <br />all lawns and exterior plantings except that the Association may elect not to maintain <br />gardens and plantings established by individual Owners, but to the extent the <br />Association undertakes to do so, it will not be responsible for any damage to such <br />gardens and plantings due to overwatering, underwatering or improper watering. All <br />plantings shall be subject in each instance to the Board of Directors' right to disapprove <br />plantings and locations which would be disharmonious. <br /> <br />12.03 Utilities. The Association shall maintain, replace and repair sewer and <br />water lines from the street to the portion of the structure which encompasses a CIC <br />Unit. <br /> <br />11 <br />
