<br />. <br /> <br />. <br /> <br />. <br /> <br />" <br /> <br />~ <br />EN HILLS <br /> <br /> <br />MEMORANDUM <br /> <br />DATE: <br /> <br />Agenda Item 6.A.i <br /> <br />June 30, 2003 <br /> <br />TO: Mayor and City Council <br /> <br /> <br />FROM: Peter Hellegers, City Plann@ <br /> <br /> <br />SUBJECT: Vacation ofFemwood Avenue / Conveyance. of Title <br /> <br />ReQuested Action <br /> <br />The applicant is requesting the vacation of easements and a conveyance of title. <br /> <br />Overview <br /> <br />As outlined in the Master Plan PUD and Plat, the applicant has requested the vacation of <br />easements and conveyance of title for Femwood Avenue from County Road F to 164.66 feet <br />north of Guidant Drive North (to be dedicated as Cummings Park Drive on the Final Plat). <br />Guidant Corporation would dedicate utility easements and would also dedicate "Cummings Park <br />Drive" as a public road on the Final Plat. In order to vacate a street right-of-way, the City <br />Council needs to conduct a public hearing. <br /> <br />Furthermore, Guidant Corporation has petitioned the City to convey its interest in Fernwood <br />Avenue. Before conveying property the City Council can either refer the proposed sale to the <br />Planning Commission or adopt a resolution stating that referral to the Planning Commission is <br />not necessary because the proposed sale has no relationship to the Comprehensive Plan. The <br />attached resolution would waive referral to the Planning Commission and would authorize the <br />Mayor to execute a deed of conveyance for the property. <br /> <br />Vacation ofFemwood--CC Memo 06130/2003 - Page I of2 <br />
