<br />. <br /> <br />. <br /> <br />. <br /> <br />ARDEN HILLS REGULAR CITY COUNCIL MEETING MINUTES <br />JUL Y 14, 2003 <br /> <br />9 <br /> <br />In making a decision regarding the necessity to pump, one must look at what is <br />actually being affected by the water levels. Does lake living in Minnesota entail <br />the fluctuation of water levels which traditionally affect one's dock or one's trees? <br />If on the other hand, the water levels are directly affecting one's home, and a <br />decision is made by the City to pump the water, an appropriate avenue for the <br />removal of the water must then be determined. <br /> <br />Last year the City of Arden Hills made a decision to pump Karth Lake utilizing the <br />storm system on Wyncrest Court. This system had been previously untested for <br />the approximate 15 million gallons of water the City intended to pump. I was <br />harmed by this decision. I cannot allow this to reoccur. Please be advised that <br />should the City make a decision to pump Karth Lake utilizing the storm system on <br />Wyncrest, Court, I will take every legal avenue available to me to cease such <br />action and any costs incurred therein will be passed onto the City. (I have been <br />advised by legal counsel that I am entitled to pursue an injunction as well as any <br />costs related to same should this situation reoccur.) Should it become necessary to <br />obtain a thorough inspection of the storm system in front of my dwelling from an <br />independent engineering firm, this cost will also be passed on to the City. If it <br />becomes necessary to pursue formal legal action in this matter, I will pursue all <br />claims and damages to which I am entitled. Sincerely, <br /> <br />Councilmember Holden asked how long, time wise, the temporary solution was <br />good for. <br /> <br />Mr. Landwer replied their intent last year was for a month of pumping. <br /> <br />Mayor Aplikowski opened the Public Hearing at 8:25 p.m. <br /> <br />Mike Enz, 1228 Karth Lake Drive, stated he would like to hear from the DNR <br />representative. <br /> <br />Travis Germundson, DNR Hydrologist for Ramsey and Washington <br />Counties, stated they were not encouraging the City to pursue or not pursue this <br />project because the City would have to apply for a permit from the State. He <br />stated they were not for or against this project, but wanted to hear input from the <br />residents. He stated they had no problem issuing a permit, but they did not want to <br />continue temporary permits. He stated they wanted something permanent <br />constructed on the basin, even if the pumping would be temporary. He stated he <br />
