Applications for Change in Use Overview Ramsey County is currently in the process of evaluating publicly owned property in Arden Hills. As part of the process, they are evaluating tax forfeit properties in which the City has a use deed for. By acquiring a use deed, the City is allowed to use tax exempt property for certain public pmposes including, but not limited to, parks, utilities, and drainage. During the course of their evaluation, Ramsey County determined that the City was not in compliance with the public pmpose outlined on the original use deed for three parcels in the Edgewater neighborhood. See the attached map for the specific locations of the parcels. Use deeds for these parcels were originally acquired in the 70's for passive park pmposes. Based on a determination by the Ramsey County Tax Forfeited Lands Division, the site is not being used for this pmpose. While City staff respectfully disagrees with this interpretation, we will also need the property for drainage pmposes for the upcoming neighborhood reconstruction project. As such, we have been working with the Tax Forfeited Lands Division on an application to change the use to drainage. This process requires the adoption of a resolution by the Council approving the application for a change in use. This is attached for your review and consideration. Requested Action I.
