Commission Findm!!s and Recommendation: <br /> <br />- <br /> <br />At their August 6, 2003 meeting the Planning Commission recommended approval of the <br />variance request and made the following findings: <br /> <br />1. The circumstances for which the variance has been requested are unique to the property. <br />2. Granting of the variance would be in keeping with the spirit and intent of the City's <br />Zoning Code. <br />3. The property in question could not be put to a reasonable use without the granting of a <br />variance. <br />4. The hardship was not created by the property owner. <br />5. Granting the variance would not alter the essential character ofthe neighborhood. <br /> <br />Therefore, in Planning Case #03-19, the Planning Commission is recommending that the <br />variance request of nine (9) feet for the lake shore structure setback be approved subject to the <br />following conditions: <br /> <br />1. (Note: As stated above the DNR will not provide a written statement indicating <br />approval or denial for this application. Therefore, because this condition could not be <br />reasonably fulfilled, staff would recommend that this condition be removed.) The <br />applicant shall receive written approval from the Commissioner of Natural Resources and <br />shall provide the City with a copy of such approval prior to the issuance of a building <br />permit. <br /> <br />- <br /> <br />2. All necessary applications for building permits shall be filed with the Building Official <br />for approval prior to the issuance of a building permit. <br /> <br />ODtions <br /> <br />1. Recommend approval as submitted. <br />2. Recommend approval with conditions. <br />3. Recommend denial with reasons for denial. If the City denies the petitioners request, <br />". . .it must state in writing the reasons for the denial at the time it denies the request." <br />4. Table for additional information. <br /> <br />Deadline for A!!encv Actions <br /> <br />The City of Arden Hills received the completed application for this request on July 8, 2003. <br />Pursuant to Minnesota State Statue, the city must act on this request by September 7, 2003 (60 <br />days), unless the City provides the petitioner with written reasons for an additional 60 day review <br />period.
