PLANNING CASE #03-25 - GUIDANT MASTER PLAN PUD (SECOND)
AMENDMENT. 2100 NORTH RAMUNE AVENUE

Chair Sand opened the public hearing at 8: 10 p.m.

Mr. Hellegers stated applicants were requesting approval of a second amendment to the
previously approved Master Plan Planned Unit Development (PUD). Staff recommended
approval based on the following conditions:

1. The applicant shall continue to abide by the conditions of approval as stated in the
approved Master Plan PUD. .
2. The Phasing Schedule shall be amended to reflect the 38,000 square foot addition
to Building N in Phase One (2003-2006)

Chair Sand invited anyone for or against the variance to come forward and make
comment.

Brad Kessler, 1251 Wyncrest Court, stated he was a member of the workgroup meeting
and he noted he was pleased with how Guidant worked with the neighbors. He stated the
building did not meet the setback requirements. He noted when people walked the trails;
it was very noisy in the comer because they placed air conditioner units along that comer.
He expressed concern about the height of the building. He stated he would like the
building space to not go into the setback and remove the fans from the air conditioners
away from the neighborhood area. He asked how the changes would affect the whole
PUD. Mr. Hellegers replied with respect to the setback issue, the northwest comer was
approximately 68 feet and the requirements required a 20-foot setback. He noted this
was approved on the Master Plan PUD approved in 2002. He indicated the building
would be more than 100 feet away from the property line. With respect to lot coverage, it
would be a change of.3 percent.

Commissioner Ricke asked if parking areas counted for lot coverage. Mr. Hellegers
replied they did not, but he had given the Commission the lot coverage figures for the
parking structures.

.

Judd Brasch, RSP, stated when the building was added to the Master Plan PUD there
were flour silos, which had been since demolished. He believed the silos were 40 feet in
height. He indicated the existing structure was approximately 26 feet and the proposed
addition would match that height. He noted there would be some mechanical units on the
