<br />. <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />, <br /> <br />~ <br /> <br />~ <br />EN HILLS <br /> <br /> <br />MEMORANDUM <br /> <br />DATE: <br /> <br />Agenda Item 6.C <br /> <br />September 29, 2003 <br /> <br />TO: Mayor and City Council <br /> <br />FROM: Peter Hellegers, City Plaune@ <br /> <br />SUBJECT: Case #03-22 <br />Earl and Judith Nolting <br />3336 Lake Johauna Boulevard <br />Variance (Zoning Ordinance) <br /> <br />Requested Action <br /> <br />The applicant is requesting a variance of 36.96 feet from the front yard setback, a variance of 5 <br />feet from the current side yard setback for accessory buildings, and a variance to Section 6, A, 3 <br />which states that no accessory structure shall be nearer the front lot line than what is the required <br />front setback. The variances would allow the applicant to construct a new two-car garage in <br />approximately the same location as the existing two-car garage. <br /> <br />Planninl! Commission Findinl!s and Recommendation: <br /> <br />At their September 3, 2003 meeting the Planning Commission made the following findings: <br />I. The circumstances for which the variances have been requested are unique to the <br />property. <br />2. Granting of the variances would be in keeping with the spirit and intent of the City's <br />Zoning Code. <br />3. The property in question could not be put to a reasonable use without the granting of the <br />vanances. <br />4. The hardship was not created by the property owner. <br />5.
