<br />PLANNED UNIT DEVELOPMENT <br />PERMIT/DEVELOPMENT AGREEMENT <br />ARDEN HILS DEVELOPMENT FILE NOS. 01-30 AND 02-20 <br /> <br />. <br /> <br />1.0 Parties, This Agreement is made and entered into this _ day of November, <br />2003, by and between Aaron $, Nelson ("Permitee") and City of Arden Hills, a <br />Minnesota statutory city ( "Arden Hills"), <br /> <br />2.0 Recitals, <br /> <br />A. Permitee represents that it is the record fee owner of that certain real <br />property described as follows: Lot 13, Block 2, Dalsoren Addition, <br />Ramsey County, Minnesota, (the "Nelson Property"), <br /> <br />C. <br /> <br />B, On the 31 st day of October, 2001, Permitee applied to Arden Hills for a <br />Master and Final Planned Unit Development Permit (the "Initial PUD <br />Application"), as contained in Arden Hills File No, 01-30. The Initial PUD <br />Application, if approved, would allow the Permitee to develop the Nelson <br />Property for an office building and improvements consistent with site plans <br />dated the 1st day of November, 2001, <br /> <br />On the Stl1 day of December, 2001, the Arden Hills Planning Commission <br />reviewed Permitee's Initial PUD Application and recommended approval, <br />subject to certain conditions. <br /> <br />. <br /> <br />D. On the 10th day of December, 2001, the Arden Hills City Council reviewed <br />Permitee's Initial PUD Application, the Planning Commission's <br />recommendations, the Arden Hills staff recommendations and approved <br />Permitee's PUD Application subject to execution of a development <br />agreement which included the conditions of approval. <br /> <br />E. The Arden Hills regulations indicate that permits will expire unless the <br />project is commenced within one (1) year. <br /> <br />F. On the 6th day of August, 2002, Permitee applied to Arden Hills for an <br />amendment (the "Amended PUD Application") to the previously <br />approved Initial PUD Application, The Amended PUD Application, if <br />approved, would allow Permitee to develop the Nelson Property for an <br />office building and improvements, consistent with a revised site plan <br />prepared by Busch Caulfield Architects, dated the 18th day of November, <br />2002, and attached as Exhibit A. <br /> <br />G. <br /> <br />On the 27th day of August, 2002, the Arden Hills Planning Commission <br />reviewed Permitee's Amended PUD Application, the recommendations of <br />the Arden Hills staff, and recommended approval subject to certain <br />conditions, <br /> <br />. <br />
