PLANNED UNIT DEVELOPMENT PERMIT/DEVELOPMENT AGREEMENT ARDEN HILS DEVELOPMENT FILE NOS. 01-30 AND 02-20 . 1.0 Parties, This Agreement is made and entered into this _ day of November, 2003, by and between Aaron $, Nelson ("Permitee") and City of Arden Hills, a Minnesota statutory city ( "Arden Hills"), 2.0 Recitals, A. Permitee represents that it is the record fee owner of that certain real property described as follows: Lot 13, Block 2, Dalsoren Addition, Ramsey County, Minnesota, (the "Nelson Property"), C. B, On the 31 st day of October, 2001, Permitee applied to Arden Hills for a Master and Final Planned Unit Development Permit (the "Initial PUD Application"), as contained in Arden Hills File No, 01-30. The Initial PUD Application, if approved, would allow the Permitee to develop the Nelson Property for an office building and improvements consistent with site plans dated the 1st day of November, 2001, On the Stl1 day of December, 2001, the Arden Hills Planning Commission reviewed Permitee's Initial PUD Application and recommended approval, subject to certain conditions. . D. On the 10th day of December, 2001, the Arden Hills City Council reviewed Permitee's Initial PUD Application, the Planning Commission's recommendations, the Arden Hills staff recommendations and approved Permitee's PUD Application subject to execution of a development agreement which included the conditions of approval. E. The Arden Hills regulations indicate that permits will expire unless the project is commenced within one (1) year. F. On the 6th day of August, 2002, Permitee applied to Arden Hills for an amendment (the "Amended PUD Application") to the previously approved Initial PUD Application, The Amended PUD Application, if approved, would allow Permitee to develop the Nelson Property for an office building and improvements, consistent with a revised site plan prepared by Busch Caulfield Architects, dated the 18th day of November, 2002, and attached as Exhibit A. G. On the 27th day of August, 2002, the Arden Hills Planning Commission reviewed Permitee's Amended PUD Application, the recommendations of the Arden Hills staff, and recommended approval subject to certain conditions, .
