<br />, ' <br /> <br />ARDEN HILLS PLANNING COMMISSION - OCTOBER 1, 2003 <br /> <br />3 <br /> <br />. <br /> <br />Big 10 Sports Bar, he has had nothing but problems regarding noise, drinking, litter, and <br />other issues, He noted he had spoken with the City many time about this business and the <br />problems they were having and were told that nothing could be done because the business <br />was there before the residents, He stated they have had cars drive through their yard, as <br />well as noisy, loud cars at all hours of the morning, He stated trash had been placed in <br />his yard from the business, He noted he had called Ramsey County many times with <br />complaints, He indicated the business had been taken over by James from John and he <br />felt it had gone downhill since the new management. He stated if this variance was <br />granted, he wanted a ten-foot high solid fence put up to protect his property. He noted <br />the air conditioning on the roof was also loud, He stated when they moved in, it was the <br />Big 10 Supper Club and they had no problems when it was the Big 10 Supper Club, <br /> <br />Mr, Welsch stated the Big 10 Was built in 1959 and the trailer court moved in around <br />1965 and the trailer park was suppose to have built a fence, but never did, He noted it <br />was the trailer court's responsibility to build the fence. He indicated he had put up a <br />fence, but it was not required. <br /> <br />Vice Chair Zimmerman closed the public hearing at 7:26 p,m, <br /> <br />. <br /> <br />Comfnissioner Ricke moved, seconded by Commissioner Modesette to recommend <br />denial of Planning Case #03-12, John Welsch, 4703 North Highway 10, Variance requcst <br />to allow the enlargement of a non-conforming use based on the findings stated in staff's <br />October 1, 2003 report; and denial of the Site Plan based on its failure to comply with the <br />zoning, landscaping, and parking requirements, <br /> <br />The motion carried unanimously (4-0), <br /> <br />B. PLANNING CASE 03-26: RAMSEY COUNTY PUBLIC WORKS, 1425 WEST <br />IlIGHW AY 96, SPECIAL USE PERMIT AMENOMENT <br /> <br />Vice Chair Zimmerman opened the public hearing at 7:28 p,m, <br /> <br />Mr, Hellegers stated applicant was reqiiesting an amendment to their Special Use Permit <br />to allow for an addition of the Sheriff Station to the Public Works Facility and also to <br />allow a change in the Site Plan for the addition and the relocation of the salt/sand <br />building, Staff noted the Planning Commission needed to make a detennination that in <br />reviewing the proposed amendment to the Special Use Permit, the Commission has <br />considered the effect of the proposed use upon the health, safety, convenience, and <br />general welfare of the owners and occupants of surrounding land, in particular, the <br />community as a whole and that the facts and circumstances of the particular case warrant <br />granting of the amendment to the Special Use Permit. Staff recommended approval of <br />the Special Use Permit Amendment subject to the following conditions: <br /> <br />. <br /> <br />I, All necessary building permits shall be filed with the City Building Official. <br />2, All necessary signage shall be filed with the City Planner. <br />3. The number of handicapped accessible parking spaces shall comply with the State <br />Building Code requirements. <br />4. The applicant shall submit a revised landscape plan and planting schedule whicb <br />complies with the City's landscaping requirements for the required caliper inches of <br />
