<br />. <br /> <br />. <br /> <br />. <br /> <br />Deadline for A2ency Actions <br /> <br />The City of Arden Hills received the completed application for this request on October 29,2003. <br />Pursuant to Minnesota State Statue, the city must act on this request by December 29, 2003 (60 <br />days), unless the City provides the petitioner with written reasons for an additional 60 day review <br />period. The city may with the petitioner's consent extend the review period beyond the 120 <br />days. <br /> <br />Ontions <br /> <br />1. Recommend approval as submitted. <br />2. Recommend approval with conditions. <br />3. Recommend denial. If the City denies the petitioner's request, "... it must state in <br />writing the reasons for the denial at the time that it denies the request". <br />4. Table for additional information. <br /> <br />Determination and Recommendation <br /> <br />A. <br /> <br />Determination: The Planning Commission must make a determination that in reviewing <br />the proposed amendment to the Special Use Permit. the Commission has considered the <br />effect of the proposed use upon the health, safety. convenience and general welfare of the <br />owners and occupants of surrounding land. in particular, and the community as a whole <br />(see the text of #15 [Zoning reference Section 8, D, 3, bJ for the specific factors to <br />review), and thatthat the facts and circumstances of the particular case warrant granting <br />of the amendment to the Special Use Permit. <br /> <br />B. Conditions of Approval: Following the determination, the Planning Commission may <br />include that the approval of the amendment to the Special Use Permit be subject to <br />eertain conditions of approval as the Commission deems necessary to serve and protect <br />the health, safety, convenience, and general welfare of the community. <br /> <br />Staff would recommend approval subject to the following conditions: <br />I. The applicant shall submit additional drawings including a mounting detail and a <br />detail on any other structural work, plans to be approved by City Engineer prior to <br />the installation of the antenna or any associated construction. <br />2. The applicant shall submit a revised sheet I to the City Engineer showing the <br />building and electrical code reference numbers from the International Building <br />Code (IBe). <br />3. Compliance with the applieable provisions of the Zoning Ordinance. <br />4.
