The City shall hold harmless and defend Grantor for all claims or <br />damages, of whatever kind, arising out of the City's failure to properly maintain, operate, <br />inspect and/or repair the above-described Easement Area and/or the public <br />improvements located therein. <br /> <br />2. This easement shall only permit the City to access the Easement Area to <br />maintain, operate, inspect or repair the storm water drainage basin, the french drain, the <br />outlet pipes, the boulder weir and/or the water main located within the Easement Area <br />to insure that such public improvements are functioning as designed. <br /> <br />3. The easement rights granted hereby do not allow the City to construct <br />improvements within the Easement Area unrelated to the storm water drainage basin, <br />the french drain, the outlet pipes, the boulder weir and the water main. No public trails, <br />roads or pathways shall be constructed within the Easement Area. <br /> <br />2 <br />
