<br />. <br /> <br />e <br /> <br />e <br /> <br />.., .'" .. <br /> <br />PLANNED UNIT DEVELOPMENT <br />PERMIT/DEVELOPMENT AGREEMENT <br />ARDEN HILS DEVELOPMENT FILE NO. 04-06 <br /> <br />1.0 Parties. This Agreement is dated the 29th day of March, 2004, by and between MSP <br />COMMERCIAL, a Minnesota corporation ("Permitee") and CITY OF ARDEN HILLS, <br />a Minnesota statutory city ("Arden Hills"). <br /> <br />2.0 Recitals. <br /> <br />A. Permitee represents that it is the record fee owner of that certain real property <br />described as follows: Lot 13, Block 2, Oalsoren Addition, Ramsey County, <br />Minnesota (the "MSP Property"). <br /> <br />B. On the 4th day of February, 2004, Permitee applied to Arden Hills for a Master <br />and Final Plan Planned Unit Development Permit (the "PUD Application"), <br />as contained in Arden Hills File No. 04-06. The PUO Application, if approved, <br />would allow the Permitee to develop the MSP Property for an office building <br />and improvements. <br /> <br />C. <br /> <br />Prior to receipt of the PUD Application, Arden Hills had previously approved <br />development permits in connection with Planning File Nos. 01-30 and 02-20 <br />for the MSP Property. <br /> <br />D. On the 3rd day of March, 2004, the Arden Hills Planning Commission <br />reviewed Permitee's PUD Application, the recommendations of the Arden <br />Hills staff, and recommended that the Arden Hills City Council approve the <br />PUD Application subject to certain conditions. <br /> <br />E. On the 29th day of March, 2004, the Arden Hills City Council reviewed <br />Permitee's PUD Application, the Planning Commission's recommendations, <br />the Arden Hills staff recommendations and approved Permitee's PUO <br />Application subject to execution of a development agreement which included <br />the conditions of approval. <br /> <br />3.0 Terms of Permit. Now therefore, the Arden Hills City Council hereby approves the <br />Master and Final Plan PUD for the MSP Property, subject to the following conditions: <br /> <br />A. Use of Property. The MSP Property may be used for an office building and <br />improvements as illustrated on the architectural plans prepared by Genesis <br />Architecture, dated January 19, 2004, which are attached as Exhibit A, <br />subject to the following conditions: <br /> <br />1. <br /> <br />Review of Construction Plans. Building permit plans shall be <br />submitted to the Building Official at least two (2) weeks before the <br />planned start of construction. <br />
