The Special Use pennit recorded docwnent was last <br />modified in 1978 with Planning Case 78-05. The Special Use Permit has been <br />modified throughout the years without modifying the recorded docwnent. Staff <br />recommends a new Special Use Permit be recorded with this Planning Case for the <br />following reasons: <br /> <br />L The legal description has changed with the addition of the proposed athletic fields <br />area across Highway 10. <br />2. Existing conditions with past Planning Cases should be incorporated. <br /> <br />Deadline for Al!encv Actions <br />The City of Arden Hills received the completed application for this request on November <br />1,1999. Pursuant to MilUlesotaState Statute the City must act on this request by <br />Thursday, December 30, 1999 (60 days), unless the City provides the petitioner with <br />written reasons for the additional 60 day review period. The additional review period <br />would extend to Monday, February 28, 2000. The City may with the petitioners consent <br />extend the review period beyond the Monday, February 28, 2000 date. <br /> <br />Due to various reasons some of which include the complexity of the applications received <br />md limited staff time the December t, 1999 Planning Commission was canceled. The <br />City informed the applicmt that an additional 60 days would be needed to process this <br />application. <br /> <br />Lastly if the City denies the petitioners request, "... it must state in writing the reasons for <br />the denial at the time that it denies the request." <br /> <br />Options <br />L Recommend approval as submitted. <br />2. Recommend approval with conditions. <br />3. Recommend denial with reasons for denial. <br />4. Table for additional information. <br /> <br />Recommendation <br />Staff recommends approval of the amendment to the Special Use Pennit amendment <br />(updating the Master Plm) and site plan review (for the park facility), in Planning Case <br />00-01, subject to the following conditions: <br /> <br />L Execution of a new Special Use Permit Document 00-01; <br />2. Dedication of a trial easement for the existing trail to be prepared md recorded by the <br />applicant and approved by Staff; <br />3. Compliance with the height for structures; <br />4. Compliance with requirements of the Shorcland Management regulations; <br />5. Approval of the plans Rice Creek Watershed District approval; <br />6. Compliance with the Lighting standards of the Zoning Ordinance. <br />7. No lighting be erected for the ball fields and tennis courts; <br />8. The sewer be extended and the bathrooms be changed to a permanent structure; <br />
