The Special Use Permit has been modified throughout the years without modifying the recorded docwnent. Staff recommends a new Special Use Permit be recorded with this Planning Case for the following reasons: L The legal description has changed with the addition of the proposed athletic fields area across Highway 10. 2. Existing conditions with past Planning Cases should be incorporated. Deadline for Al!encv Actions The City of Arden Hills received the completed application for this request on November 1,1999. Pursuant to MilUlesotaState Statute the City must act on this request by Thursday, December 30, 1999 (60 days), unless the City provides the petitioner with written reasons for the additional 60 day review period. The additional review period would extend to Monday, February 28, 2000. The City may with the petitioners consent extend the review period beyond the Monday, February 28, 2000 date. Due to various reasons some of which include the complexity of the applications received md limited staff time the December t, 1999 Planning Commission was canceled. The City informed the applicmt that an additional 60 days would be needed to process this application. Lastly if the City denies the petitioners request, "... it must state in writing the reasons for the denial at the time that it denies the request." Options L Recommend approval as submitted. 2. Recommend approval with conditions. 3. Recommend denial with reasons for denial. 4. Table for additional information. Recommendation Staff recommends approval of the amendment to the Special Use Pennit amendment (updating the Master Plm) and site plan review (for the park facility), in Planning Case 00-01, subject to the following conditions: L Execution of a new Special Use Permit Document 00-01; 2. Dedication of a trial easement for the existing trail to be prepared md recorded by the applicant and approved by Staff; 3. Compliance with the height for structures; 4. Compliance with requirements of the Shorcland Management regulations; 5. Approval of the plans Rice Creek Watershed District approval; 6. Compliance with the Lighting standards of the Zoning Ordinance. 7. No lighting be erected for the ball fields and tennis courts; 8. The sewer be extended and the bathrooms be changed to a permanent structure;
