The approximate <br />huilding heights were outlined in the staff report to the Planning Commission; however, the <br />hardship requirements were not discussed at the March 3,d meeting. This was likely due to the <br />confusing nature of the SUP Master Plan, where master plans are common to PUDs and do not <br />require hardship findings. Heritage Hall which has a very similar design received a 7' 8" height <br />variance from the 35' foot maximum. The new sophomore dormitory would require a variance <br />of 8'for the height of the majority oftlle building (2'6" of which is parapet walls), a variance of <br />11.5' for the height of the elevator penthouse, and a variance of 17' for the architectural feature <br />at the internal comer of the east side of the building. The variance hardship criteria findings, <br />with staffs interpretation of the hardship shown in bold text, are listed below for Council's <br />revIew <br /> <br />1. <br /> <br />Whether the circumstances for which the variance is requested are unique to the <br />property. Yes, there is only one other college property (Northwestern) in the City <br />of Arden Hills which could claim a similar hardship. However, Northwestern <br />College is located in a R-I zone whereas Bethel College is located in a B-1 zone. <br />Whelher granting the variance would be in keeping with the spirit and intent of the <br />City's Zoning Code. Yes, granting of the variances does not appear to be <br />inconsistent with the City's purpose and intent. <br />Whether the property in question can be put to a reasonable use without the granting <br />of a variance. No, without granting of the variance the applicant would need to <br />build a building with a larger footprint which would conflict with the City's <br />requiremeut for landscape lot area. <br />Whether the hardship was created by the property owner. No, the dormitory was <br />already approved in a different location on the campus and would've also <br />required a height variance. <br />Whether granting the variance will alter the essential character of the neighborhood. <br />No, the impact on surrounding properties would be limited as this dormitory is <br />proposed for far northeastern part of the campus.
