<br />~ <br />~ILLS <br /> <br />MEMORANDUM <br /> <br />e <br /> <br />DATE: <br /> <br />October 25, 2004 <br /> <br />Agenda Item 7.A <br /> <br />TO: <br /> <br />Mayor and City Council /:::J <br />Peter Hellegers, City Plarutr W <br /> <br />FROM: <br /> <br />SUBJECT: <br /> <br />Planning Case #01-05 <br />Extension for Master Plan POD - NE Quadrant/Interstate Crossing <br />Chesapeake Companies <br />NE Quadrant ofI-694 and 1-35W <br /> <br />Requested Action <br /> <br />The applicant has requested a one-year extension for the Master Plan POD. <br />(The Zoning Ordinance states that "within six months after obtaining Master Plan approval, or <br />within such extended period aftime as the council has agreed to" [See, 5N6aJ, the applicant <br />shall submit a Final Plan PUD). <br /> <br />Backl!rlmnd <br /> <br />. <br /> <br />At their meeting on March 26,2001 the Arden Hills City Council approved a Master Plan POD <br />for Chesapeake Companies subject to 13 conditions. Condition 13 states that "Due to the time <br />requirements of land acquisition and securing major tenants, the time requirement for the final <br />plan to be submitted no more than six months after the date of City Council's approval of the <br />Master POD be changed to eighteen months for this proposa1." It is clear that the Council at that <br />time recognized that this project would not be ready for development within the standard POD <br />framework. Subsequent to this approval the office market fell to its lowest level in years and has <br />not since fully rebounded, Chesapeake came back to the Council on two other occasions for <br />extensions to their POD, <br /> <br />The major issues that surrounded this project in the past appear to be approaching resolution, <br />Chesapeake has a signed purchase agreement with the owners of the ATS Steel property and has <br />also signed a purchase agreement with MT Properties who owns the old railroad spur. These <br />two accomplishments have all but assembled the property to the configuration which had been <br />proposed in the Master Plan POD. The property assemblage problem appearing solved, <br />Chesapeake has been working with Northstar Partners to market the property to potential tenants, <br />Marketing activities include executive marketing letters, monthly broadcast e-mails, marketing <br />material preparations, and even sponsoring a hole at a MNCAR golftoumament.
