BOB FLETCHER RAMSEY COUNTY SHERIFF ~ 425 Grove St. St. Paul, MN 55101-2418 Telephone: (651) 266-9300 Telelacsimile: (651) 266-9301 e December 10, 2004 Arden Hills City Council 1245 West Highway 96 Arden Hills MN, 55112 Mayor and City Council members, The staff at the City of Arden Hills City has recently researched the issues related to vehicular noise associated with the truck driving technique know as jake braking, I have reviewed the enforcement aspects of such an ordinance with Captain Jay Swanson of the Minnesota State Patrol, Tim Entner, our Traffic Deputy, along with Lieutenants Mike Salter and Joe Paget of the Sheriff's Department. In researching the Minnesota ,. State Statntes, I find no related law that prohibits such driving techniques, Thus, this . would limit enforcement efforts to monitoring noise levels with calibration devices, The Minnesota State Patrol advised me that they would not get involved in the enforcement of such an ordinance, I feel a new noise ordinance, and directed enforcement efforts from the Sheriffs Department would need to be uniformly enforced across the City and include other related traffic noise. This would require a substantial increase in our patrol resources. I believe that such enforcement efforts are not in keeping with the primary policing and service efforts, Additionally, I don't believe that such enforcement efforts would produce the desired outcome in reducing the traffic related noise associated with these driving techniques.
