<br />I <br />Extensions beyond 2007 shall require application to the City Council for review and <br />approval. At the time of application for extensions, the City Council may include such <br />conditions of approval as they determine necessary for compliance with City Code. <br />3. Number of Businesses in a Unit. 30 office condominium uses have been proposed for <br />development on individual lots. Only one business shall be permitted to occupy anyone <br />lot within the development. <br />4. Retail Uses. Retail uses shall not be allowed to occupy any of the units in the proposed <br />development, except for incidental or accessory sales. <br />5. Restaurant Uses. Restaurant uses shall not be allowed to occupy any of the units in the <br />proposed development. <br />6. Residential Uses. Residential uses shall not be allowed to occupy any of the units in the <br />proposed development. <br />7. Landscaping Plans. The applicant shall submit a revised landscape plan for review and <br />approval by the City Planner prior to the issuance of building permits. The revised <br />landscape plan shall include a mixture of coniferous and deciduous trees along the west <br />buffer yard of the development. The mixture of landscaping shall adequately screen the <br />development from the residential properties to the west. <br />8. Tree Preservation. The applicant and their contractors shall work with the City Planner <br />and City Forester to save as many existing, healthy, and well placed trees as possible in <br />the areas designated as landscape space. <br />9. Sign age. One freestanding monument sign at the Highway 96 entrance shall serve for <br />the development which shall conform to the City's Sign Ordinance restrictions. Wall <br />signage within the development shall include 30 square feet for each unit in accordance <br />with the City's Sign Ordinance restrictions. Signage shall be limited to the front of the <br />building. <br />10. Screening of Mechanical Operating Equipment. All mechanical operating equipment <br />shall be screened to meet City regulations. <br />11. Decorative Fencing to Surround the Pond. Decorative painted fencing (like painted <br />wrought iron fencing) shall be erected around the pond at the northeast corner of the <br />property to protect pedestrians from falling into the pond. <br />12. Execution of a PUD Permit. Execution of a PUD Permit drafted by the City Attorney <br />and approved by the City Council prior to the issuance of a Building Permit. <br />13. Park Dedication. Satisfaction of the park dedication requirements as approved by the <br />City Council in the amount of$40,000.00. <br />14. Final Plat. The applicant shall submit an application for a Final Plat within six (6) <br />months following City Council approval of the PUD and Preliminary Plat. <br />15. Necessary Approvals from Other Agencies. The applicant shall obtairc all necessary <br />permits from the Rice Creek Watershed District and Ramsey County. <br />16. Building Setback from City Trail. Units 1,2, and 3 of the proposed development shall <br />be set back at least 15 feet from the existing trail on the west side ofthe property. <br />17. Hamline Avenue Entrance. To facilitate movement in and out of the development, a <br />minimum 30-foot radii shall be built on the northwest and southwest corner of the <br />intersection.
