<br />Concept PUD. The applicant has submitted a full EA W, with comments received <br />by the Minnesota Department of Natura] Resources, Minnesota Pollution Control <br />Agency and the Minnesota Historica] Society. This document includes a map of <br />existing conditions, showing all significant natura] features, and grading, utility <br />and erosion control plan. Development of the project will require a limited <br />amount of wetland encroachment. Proposed mitigation includes 2:] replacement <br />of the impacted wetland with on-site ponding. A permit will be required from <br />Rice Creek Watershed District. <br /> <br /> <br />k) Shoreland Ordinance. The subject property is located in the Shoreland <br />Management area, per the Minnesota Department of Natural Resources (DNR). <br />The City Code, in Chapter 20.5-22, subpart 12 (a) defines a Shoreland as land <br />located within 1,000 feet from the ordinary high water mark of a lake, pond or <br />f1owage. The subject property is within ],000 feet of Round Lake, a DNR <br />protected water. <br /> <br />The City Code, in Chapter 20.5-47 (a)#1 permits the selective removal of natural <br />vegetation, provided that sufficient vegetative covers remains to screen cars, <br />dwellings and other structures when viewed from the water. Grading and <br />excavation is allowed in a shoreland area, as long as the following conditions are <br />satisfied: <br /> <br />i) <br /> <br />The smallest amount of bare ground is exposed for as short a time as <br />feasible; <br />Temporary ground cover, such as mulch, is used and permanent ground <br />cover, such as sod, is established; <br />Methods to prevent erosion and trap sediments are employed; and <br />Fill is stabilized to accepted engineering standards, approved by the City <br />Engineer. <br /> <br />. <br /> <br />ii) <br /> <br />iii) <br />iv) <br /> <br />I) Easements & Utilities. There are a total of eight easements on the site. Utility <br />lines are required to be underground in all development within the Gateway <br />Business District by the Zoning Ordinance. There are abandoned water and sewer <br />lines running east to west through the property. There is also an abandoned gas <br />main filled (presumed) with concrete running north to south across the west edge <br />ofthe property. <br /> <br />Variance Procedures and Review <br />The Gateway Business District was, ".. .established specifically to provide a flexible <br />framework for the development of the area of the City generally located in the northeast <br />quadrant of the interchange at 1-694 and 1-35W". <br /> <br />The purpose of a POO is to relax the strict application of standard zoning and subdivision <br />requirements to realize benefits of custom site design (i.e. preserving open space, ctc.). <br />Howcver, the Zoning Ordinance language is vague regarding flexibility of standards <br />within a PUD. Therefore, past PUDs have been evaluated according to the underlying <br /> <br />,4 <br /> <br />6 <br />
