Moore, Operations and Maintenance Director ,~. / I v ~l...A..- <br /> <br />SUBJECT: Carroll vs, City of Arden Hills - Sewer Back-Up (Confidential Pending <br />Litigation) <br /> <br />BACKGROUND: <br />Please refer to Murtuza Siddiqui's memorandum dated January 4,2005 to Michelle Wolfe for <br />background information. This memorandum was previously distributed to the Council for a <br />confidential discussion. <br /> <br />DISCUSSION: <br />As you recall from the previous memorandum, three residents were impacted by the sewer back- <br />up, So far the City had settled with the Frid's in the amount of$25,000, The Matual claim <br />settled for $8,206.32, The outstanding claim remains open with the Carroll's, They were <br />originally claiming $18,800,14 for the damages, The League's attorney has negotiated the claim <br />amount down to $12,650, <br /> <br />The League's attorney feels this to be a reasonable and fair settlement, <br /> <br />RECOMMENDED ACTION: <br />Staff recommends that the City Council approve the recommendation from the League of <br />Minnesota Cities Insurance Trust's attorney to settle the Carroll claim for $] 2,650, <br />
