<br />. <br /> <br />. <br /> <br />. <br /> <br />Should a fee be accepted in licu of a land dedication, the park dedication fee would be six <br />pcrcent of the land value of the property at the time of final approval of the subdivision. The <br />2006 market value of the entire property according to Ramsey County records is $606,500. This <br />value would result in a park dedication fee of $36,390. Although the subdivision ordinance does <br />provide a guide for calculating a park dedication ofland or money, the City Council does have <br />the discretion to reduce or eliminate the potential maximum park dedication fee of$36,390 if the <br />circumstances wanant a reduction or elimination. <br /> <br />Mr. Pogue, the representative of the Lodge, has submitted a letter requesting that the park <br />dedication fee be waived. The letter is attached to this report. <br /> <br />Staff does recommend that the City Council consider reducing or eliminating the park dedication <br />fee in this particular case due to unique circumstances. Unlike the remaining property with the <br />Lodge building, the new ly created lot does not have direct access to the lake. The high land <br />value and suhsequently high park dedication fee is due to the lake access. The proposed eastern <br />lot is worth significantly less once it no longer has direct access to the lake as part of the Lodge, <br />For example, the mcdian land value of eight properties within the same neighborhood but <br />without direct lake access is $81,600 (with a range of$56,500 to $134,500). If, for thc purposes <br />of this discussion, the land value of the new vacant lot was $81,600, the park dedication lee <br />would be $4,896. <br /> <br />Furthermore, because the applicant is consolidating three potentially legally buildable lots into <br />one pennanent and conforming lot, the future impact on the park system may have been reduced. <br /> <br />Although recommended condition four states that the park dedication fee shall be paid before the <br />subdivision is filed with Ramsey County, the City Council may permit the applicant to pay up to <br />two-thirds of the fee over a period of up t018 months subject to an agreement approved by the <br />City Attorney (Section 1130.08 Subd. 2E). One third of the payment would still be due before <br />the subdivision is filcd with Ramsey County. <br /> <br />Deadline for Al!encv Actions <br /> <br />The City of Arden Hills received the completed application for this rcquest on December 30, <br />2005. Pursuant to Minnesota State Statute, the City must act on this rcquest by February 28, <br />2006 (60 days), unless the City provides the petitioner with written reasons for an additional 60 <br />day review period. The City may with the petitioners' consent extend the review period beyond <br />the 120 days. <br /> <br />Options <br /> <br />1. Recommend approval as submitted. <br />2.
